AFFIDAVIT OF MUTUAL DESISTENCE

We, JOVEE A. UGAT, and JONATHAN B. JOYOHOY, both Filipino Citizens of legal age, attest to
the following facts:

1. We are the parties to a traffic incident last May 23, 2019, 5:50PM, at Don Bernardo Street, Cebu City.
2. That we were both making a right turn at our respective lanes when our vehicles collided.
3. That we both incurred damage to our respective vehicles as a direct result of the said incident
4. That we, in furtherance of our mutual wish to avoid further litigation over the matter, have agreed to
extrajudicially settle the matter amongst ourselves without pursuing further action.
5. That we have both agreed to bear amongst ourselves, the respective damage we have incurred as a
result of the traffic incident we had figured in.
6. That we both have mutually agreed to waive our respective rights to claim indemnity from one another
arising from the said incident.
