MEMORANDUM OF AGREEMENT

KNOWN ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA) made and entered into between;

The DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR), -

Community Environment and Natural Resources Office (CENRO) East, a Government
Agency existing under the laws of the Republic of the Philippines with office address at
Governor Chavez st, Davao City, herein represented by BERNARDINO S. JUSON, in his
capacity as the OIC, COMMUNITY ENVIRONMENT AND NATURAL RESOURCES
OFFICER , herein referred to as the “DENR-CENRO”;

The UNIVERSITY OF SOUTHEASTERN PHILIPPINES (USEP)-SCHOOL OF

APPLIED ECONOMICS (SAEc), a government academic institution existing under the laws
of the Republic of the Philippines and established under Batas Pambansa Blg. 12, with Office
address at Iñigo St, Obrero, Davao City, represented herein by its President, DR. PERFECTO
A. ALIBIN, hereinafter referred to as “USEP-SAEc”.

WITNESSETH:

WHEREAS, Executive Order No. 26 otherwise known as the National Greening Program
(NGP) was issued by His Excellency, President Benigno Simeon Aquino III, having a goal for
biodiversity conservation, climate change adaptation and in addition efforts of poverty reduction and
food security by implementing sustainable reforestation projects that will include enhance Livelihood,
environmental protection, education and public health;

WHEREAS, under the said National Greening Program, the DENR is mandated to initiate
collaborative efforts with other Government Agencies, Academe / Schools including Private Sector
and business community in order to generate support and encourage multi-sectoral participation;

WHEREAS, in pursuit of the mandate of Commission of Higher Education (CHED) thru its
different State Universities and Colleges (SUCs), to participate and support the National Greening
Program, the USEP-SAEc will adopt an area of Two (2) hectares of Urban plantation to be planted
with forest trees and ornamental plants at Davao International Airport, Sasa, Davao City ;

WHEREAS, the University of Southeastern Phippines (USEP) – School of Applied

Economics (SAEc) aside from the aforecited Two (2) hectares, they shall participate in other tree
planting activities relative to E.O. 26 and must plant Forty Thousand (40,000) seedlings as mandated;

WHEREAS, the USEP-SAEc is committed to contribute to the betterment of the society and
cooperate to the priority programs of the government on poverty reduction, resource conservation and
protection and climate change mitigation and adaption.

NOW, THEREFORE, for and in consideration of the foregoing, the PARTIES do hereby agree
to undertake its respective commitments under the following terms and conditions, viz;

The DENR shall:

1. Delineate the area allocated for urban greening project of USEP-SAEc;

2. Provide technical and silvicultural assistance to the institution ;
3. Provide the Institution with the seedlings or species that are suitable in the subject area ;
4. Conduct periodic monitoring and evaluation of the project ;

The USEP-SAEc shall:

1. Implement the planting of the suitable tree species in the adopted area and in other designated
areas;
2. Plant of at least Forty Thousand (40,000) seedlings for a period of Ten (10) years ;
3. Conduct regular maintenance and protection of the plantation ;
 4. Provide Information to the DENR whenever there are any unfavorable incidents / events that
may hamper the objective of this agreement ;
5. Submit report on the development of the adopted area ;

MISCELLANEOUS

Entire Agreement – This Agreement and any other provisions or terms specifically
incorporated herein constitute the entire agreement of the Parties and supersedes all prior agreements
that may have been executed in connection with the subject hereof. This Agreement may only be
amended by an instrument in writing signed by the respective authorized signatories of the Parties. The
terms, provisions and covenants of any such amendment/s shall inure to the benefit of and be binding
upon the Parties hereto, their successors and assigns.

Term – This agreement shall exist for a period of Ten (10) years, unless sooner terminated by
any of the Parties on account of the breach by any of the Parties of its obligations herein.

Effectivity – This Agreement shall be in force and effect upon the signing of this instrument by
the PARTIES.

IN WITNESS WHEREOF, the PARTIES have hereunto signed this Memorandum of

Agreement this 15th day of September, 2012 in Davao City, Philippines.
