P E T I TI O N

PETITIONER, through the undersigned counsel and to this Honorable


Court, most respectfully states, That:
1. Petitioner Pedro Calzado (subsequently referred to as Pedro, for brevity) is a
Filipino, of legal age, married, a resident of Lardizabal St., Brgy. 413 Zone
42, Sampaloc, Manila. He may be served with orders notices and other legal
processes of this Honorable court through her undersigned counsel and the
address stated below;

2. Co-Petitioner Ana Calzado (subsequently referred to as Ana, for brevity) is a


Filipino, of legal age, married, a resident of Lardizabal St., Brgy. 413 Zone
42, Sampaloc, Manila. She may be served with orders notices and other legal
processes of this Honorable court through her undersigned counsel and the
address stated below;

3. That they decide to change the name and to adopt the minor child named JUAN
DELA CRUZ (subsequently referred to as Juan, for brevity), who is male,
five years of age, Filipino, and likewise residing at Brgy. 402 Zone 41,
Sampaloc, Manila;

4. That the said minor, was born in East Avenue Medical Center on February 13,
2014 to THERESITA ACOSTA (Theresita for brevity), unmarried, which
proof of birth was duly registered in the Register of Births of the Office of the
Civil Registrar of Quezon City, for which a certificate of live birth was issued.
A machine copy of it is attached as Annex “____”

5., That JUAN was only two years old when his mother left him on February 19,
2016 and he was admitted with proper care and custody of the Bahay Kalinga,

a non-stock and non-profit orphanage which is located in Brgy. 602
Samapaloc, Manila;

6. The Subject child was referred by the administrator, MARIA JIMENEZ of the
Bahay Kalinga to the Department of Social Welfare and Development
(DSWD for brevity) with referring social worker, LOURDES SISSON of
DSWD-Crisis Intervention Unit together with THERESITA on March 7,
2016. After being assessed, it was found that the mother cannot support the
child with all his needs due to economic and health reasons, for which a
certificate of assessment was issued and attached as Annex “____”;

7. That during assessment, the mother, was informed of the placement status of
the child and the orphanage programs and services. She was also advised to
come and visit her son to determined her readiness to assume the role of
parenting. Unfortunately, the mother failed to fulfil such agreement. In fact,
failure to visit her child which has been deprived of the love, care and
attention from his biological mother since he was two years old up to present;

8. That the DSWD and The Bahay Kalinga in fact made a child study report in
the case of the subject minor child that; minor was deprived of parental love
and care, and it would be a best opportunity for a child to have a positive
parent-child relationship, for which a child study report attached as Annex
“____”;

9. That, on January 4, 2019, the subject minor child was formally matched to
spouses PEDRO AND ANA CALZADO and corresponding AFFIDAVIT OF
CONSENT TO ADOPTION by DSWD was issued and herein attached and
form part of the petition as Annex “_____”;

10. The Petitioners has the capability and ability to extend to said minor the kind
of financial support that a parent can give to his child. PEDRO is Senior
Police Officer I who is assigned in Cubao Police Station III while his wife,
ANA is an Office Secretary in a Lex Virtus Law Office in Manila.
Employment Identification cards of petitioners is attached as Annex “_____”
and “______”;

11. That, for the best interest, to consider the said minor as child of the Petitioners
to secure his spiritual, emotional and financial needs and taken care of his
future will be safeguarded. In fact, the couple was resided in the House
located in the safe neighborhood in Sampaloc, Manila, which was strictly
evaluated by the DSWD in its Home Study Report attached as Annex”
_____”;

12. That the spouses are of good character, has no derogatory record whatsoever
can be attributed to them, are emotionally and psychologically capable of
caring for the child. Attached herewith are copies of their NBI Clearance as
Annex “_____” and “_______”;

13. That the minor sought to be adopted does not own any real, personal, and any
other property; and

14. That the adoption is for the best interest and security of the said minor if he
would be considered as true and legal child of herein petitioners that will
make his life normal productive and as a good person in the community;

PRAYER
Wherefore, premises are considered, it is respectfully prayed of this Honorable
Court to grant this petition of Spouses of Pedro and Ana Calzado for the adoption
of Juan Dela Cruz and for the change of the minor Child’s name to Juan Santino
Calzado.
Such Relief which the Honorable Court may deem just and equitable under the
premises are likewise prayed for.
