Councilor Resolution No. 2012-411 (92"” REGULAR Session) A RESOLUTION CALLING FOR THE ENACTMENT OF AN ORDINANCE ‘TO PRESCRIBE RENTAL FEES ON LGU-ACQUIRED ETHNIC & NON- ETHNIC COSTUMES, ACCESSORIES, PROPS & INSTRUMENTS FOR TOURISM ACTIVITIES AND FOR OTHER PURPOSES, OF THE MUNICIPALITY OF KALILANGAN, BUKIDNON WHEREAS, t has been an oft-repeated happenings & experiences In the past, that borrowed LGU-acquired ethnic & non ethnic costumes, accessories, props & instruments for tourism activities and for other Purposes of the Municipality of Government of Kalilangan are either missing, lacking or lost, damaged or defaced, when retumed by the bborrower(s); WHEREAS, government funds were used for their production and/or acquisition, and, as provided for under BOOK Il, Title Six, Section 376, of the Local Government Code of 1991, "The person in actual physical possession of government property or entrusted.with its custody and Control shall be responsible for Its proper use and care and shall exercise {due dligence in the utilization and safekeeping thereof; WHEREAS, to ensure their proper utilization, safekeeping and/or preservation, it Is considered necessary and appropriate to impose rental fees on ethnic and. non-ethnic costumes, accessories, props and instruments owned by LGU Kalilangan, invoking the provisions of the Local ‘Government Code of 1991, particularly Chapter 2, Section 18 thereof} WHEREFORE, viewed from the light of the foregoing premises and upon the motion made by Hon. JOHNNY P. PADSING, SR. and severally seconded by HON. HADRIAN CHARLES R. CAMPUGAN, HON. ALPIO G. NACASABOG, JR., and HON. SIMEON R. VICERRA, the AUGUST BODY HAS! ‘esottion No, 2012-411-70-2012-020 Sana Repu Sesion Seas ben RESOLVED, to enact the following TAX ORDINANCE as follows: MUNICIPAL TAX ORDINANCE NO. 2012-020 (92° Regular Session) AN ORDINANCE IMPOSING RENTAL FEES ON ETHNIC & NON-ETHNIC COSTUMES, ACCESSORIES, PROPS & INSTRUMENTS OWNED BY LGU KALILANGAN BE IT ENACTED by the Sangguniang Bayan of Kallangan Prov Bukidnon in session assembled, THAT: be SECTION 1. TITLE. This Ordinance shall be known and cited 25, AN ORDINANCE IMPOSING RENTAL FEES ON ETHNIC & NON-ETHNIC COSTUMES, ACCESSORIES, PROPS & INSTRUMENTS OWNED BY GU RALILANGAN. SECTION II, RENTAL FEES. The following rates prescribed hereunder as rental fees shall be applied: 2. One Pair of Female Ethnic Attire = PhPL00.00 . One Pair of Male Ethnic Attire - 400.00 ¢. Blouse Only - 50.00 d. Skirt Only : 50.00 €. Headdress - 25.00 fF. Necklace and other accessories - 25.00 9. Chalico - 50.00 A. Pants - 50.00 |. Instruments: 1. Drum - 500.00 2. Agung a 500.00 3. Kulintang - 500.00/set 4. Keyboard - 500.00 5. Other Musical Instruments - 500.00 4, Props 1. Kalasag (shield) - 25.00 2. Bangkaw - 25.00 k. Non-Ethnic Costumes, - 150.00/set SECTION III. ADMINISTRATIVE PROVISIONS. The following provisions shall be observed as Administrative provisions, viz: 2. The proceeds of the rental fees shall go into the Municipal Tourism Funds and shall be treated as Trust Fund. Payment for the same shall be made at the Municipal Treasurer's Office only . Disbursements of the amount are for tourism activities only ‘subject to usual auditing rules and regulations. ‘c. In case of damages or losses the borrower is obliged to replace the item/s according to the prescribed design or pay equivalent amount based on the actual cost of the item, Sane nopui sec ‘or 23,2012 4. Safekeeping and control of LGU-acquired ethnic and non-ethnic ‘costumes, accessories, props and instruments shall be the responsibility of the Municipal Tourism Officer. Any item may be released upon signing a contract for the purpose between the LGU, wihich shall be represented by the Municipal Tourism Officer, ‘and the borrower. & Any borrower shall be given seven (7) calendar doys to rctuiss tie tems borrowed. Those who are found to be in violation shall be Charged with the corresponding rental fee herein provided every day thereafter. SECTION IV. REPEALING CLAUSE. All previous ordinances, laws or rules and regulations that are in conflict with, or contrary to the provisions of this Ordinance are hereby amended, repealed, or modified accordingly. SECTION V. _ EFFECTIVITY. This Ordinance shall take effect after ‘Ten (10) days of its posting in Three (3) conspicuous places in the municipality.
