MEMORANDUM OF UNDERSTANDING
BETWEEN
THE MINISTRY OF SOCIAL AFFAIRS OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF FAMILY, LABOUR AND SOCIAL SERVICES OF THE
REPUBLIC OF TURKEY
ON
SOCIAL WELFARE
The Ministry of Social Affairs of the Republic of Indonesia and the Ministry of Family, Labour
and Social Services of the Republic of Turkey (hereinafter referred to singularly as “the Party”
and collectively as “the Parties”)
RECOGNISING the existing friendly relations between two countries;
DESIRING to strengthen and further develop cooperation between the Parties in the field of
social weltare;
RECOGNISING the need to develop and promote mutual cooperation and coordination in
various areas of social welfare on the basis of reciprocity and mutual benefit for both countries;
BELIEVING that such cooperation would serve their common interests and contribute to the
enhancement of the social welfare and community development of the people of both countries;
NOTING to the Agreement between the Government of the Republic of Indonesia and the
Government of the Republic of Turkey on Economic and Technical Cooperation, signed on
18th December, 1982,
TAKING INTO ACCOUNT the Declaration of Intent between Ministry of Social Affairs of the
Republic of Indonesia and the Ministry of Family and Social Policy of the Republic of Turkey
on Social Welfare Cooperation, signed on 26th December 2013;
PURSUANT to the prevailing laws and regulations of their respective countries;
HAVE AGREED as follows:
Article 1
Objective
The objective of this Memorandum of Understanding is to provide framework of cooperation
between the Parties in the field of social welfare.Article 2
Scopes of Cooperation
| The scopes of cooperation referred to in the Memorandum of Understanding shall be as follows:
i . community-based welfare institutions serving the needs of family, children with special
protection, neglected elderly persons, persons with disabilities, and the poor;
. community development particularly on income-generating activities, poverty
alleviation and family development;
. social work, social service, community service and disaster risk management; and.
|. single window services for social welfare.
Article 3
Forms of Cooperation
‘The forms of cooperation referred to in the Memorandum of Understanding shall be as follows:
Exchange of information and share experiences;
._ Exchange of visits;
. Training and capacity building programs;
|. Share knowledge and best practices;
. Workshops, seminars and conferences;
Joint Research;
. Any other areas of cooperation as mutually agreed in writing by the Parties,
Article 4
Contact Points
. The Parties shall designate the following Contact Points to be responsible for the
coordination and communication for the implementation of this Memorandum of
Understandi
a. For the Ministry Social Affairs of the Republic of Indonesia: Planning Bureau;
b. For the Ministry of Family, Labour and Social Services of the Republic of
Turkey: the Directorate General of Foreign Relations.
. Any change of Contact Points of either of the Parties shall be notified in writing to the
other PartyArticle 5
Joint Working Group
. The Parties shall establish Joint Working Group composed of representatives of the
Patties, to recommend, and implement program as well as monitor and evaluate the
progress of cooperation under this Memorandum of Understanding.
. The Joint Working Group shall meet annually or otherwise as agreed, alternately in
Indonesia and in Turkey, if the annual meeting could not be held in certain
circumstances, documents shall be exchanged in lieu of such meeting.
Article 6
Action Plan
The implementation of this Memorandum of Understanding shall be arranged through
an Action Plan,
. Such Action Plan shall be developed by the Parties within the first 6 months following
the day of entry into force of this Memorandum of Understanding, The Action Plan shall
cover inter alia: the activities to be carried out, locations and duration of the activities,
funding, personnel involved and other necessary related matters.
This Action Plan shall be deemed as an integral part of this Memorandum of,
Understanding.
Article 7
ancial Arrangements
‘The Parties shall bear their own expenses incurred from any activities conducted under this
Memorandum of Understanding, unless the Parties agreed otherwise.
Article 8
Intellectual Property Rights
. Any intellectual property owned by each Party brought and used in the implementation
of this Memorandum of Understanding shall remain the property of that Party and each
Party shall be responsible for any claims filed by third party on the ownership and
validity of the said intellectual property.
. Intellectual property resulted from the implementation of this Memorandum of
Understanding shall be jointly owned by the Parties. The Parties shall conclude separate
arrangement regarding the utilization of such new intellectual property.

| Each Party shall undertake to protect the confidentiality of documents, information,
‘material and/or equipment marked as “confidential” received from or supplied by the
other Party or resulted from the implementation of this Memorandum of Understanding
or any other arrangements made pursuant to this Memorandum of Understanding to the
‘extent permitted by law.
. Upon request by either Party, the necessary measures shall be taken to avoid the
unauthorized transfer or retransfer of any documents, information, material and/or
equipment acquired during the period of the implementation of this Memorandum of
‘Understanding or any other arrangements made pursuant to this Memorandum of
Understanding.
.. This Article shall be carried out in a manner subject to and consistent with the prevailing
Jaws and regulations of the Parties,
|. The Parties agree that the provisions of this Article shall continue to be binding between
the Parties notwithstanding the termination of this Memorandum of Understanding.
Article 10
Suspension
Each Party reserves the right, for reasons of national security, national interest, public order or
public health, to suspend temporarily, either whole or in part; the implementation of this
Memorandum of Understanding which suspension shall take effect immediately after
notification has been given to the other Party through diplomatic channels,
Article 11
Amendment
. Either Party may request in writing an amendment of any part of this Memorandum of
Understanding.
. Any amendment agreed by the Parties shall be agreed in writing and shall be formed as
an integral part of this Memorandum of Understanding.
. Such amendment shall come into force on the date of signature.
. Any amendment shall not prejudice the rights and obligations arising from or based on
this Memorandum of Understanding before or up to the date of such amendment unless
agreed otherwise by the Parties.Article 12
Settlement of Differences
Any differences between the Parties concerning the interpretation and/or implementation of this
Memorandum of Understanding shall be settled amicably through mutual consultation and/or
negotiations between the Parties.
Article 13
Entry into Force, Duration and Termination
1, This Memorandum of Understanding shall come into force on the date of signature and
shall remain in force for a period of three (3) years and may be extended for a period as
mutually agreed in writing by the Parties.
. Either Party may terminate this Memorandum of Understanding by notifying in writing
the other Party of its intention to terminate it through diplomatic channels at least three
(3) months prior to the intended date of termination.
. The termination of this Memorandum of Understanding shall not affect the completion
of ongoing activities and/or programmes to be agreed upon by the Parties prior to the
date of the termination of this Memorandum of Understanding, unless agreed otherwise
by the Parties.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their
respective governments, have signed this Memorandum of Understanding.
Done in duplicate at Jakarta on 22 July 2019 each in Indonesian, Turkish and English, all
texts being equally authentic. In the event of any divergence of interpretation between any
of the texts, the English text shall prevail.
