Madras High Court directs Chief


Secretary to appear in
contempt case
Four IAS officers, including the State Chief Secretary, have been directed by the
Madras High Court to appear before it on Tuesday in connection with a contempt
case.

CHENNAI: Four IAS officers, including the State Chief Secretary, have been directed
by the Madras High Court to appear before it on Tuesday in connection with a
contempt case.
A division bench of justices K K Sasidharan and P Velmurugan gave the directive
when a contempt petition from A B Somu and 11 others seeking to punish the
authorities for their failure to comply with the court’s order, came up last week.
The order had directed Chief Secretary Girija Vaidyanathan and others to re-convey
the land in Koyambedu, to the petitioners. The three IAS officers are: the then
housing secretary Dharmendra Pratap Yadav and present one S Krishnan and CMDA
member-secretary Vijaya Rajkumar.
The contempt petition is a classic example of how the State is flouting the order
passed by the court, which has also reached the stage of finality, the bench pointed
out. The bench noted that the order passed nearly a month ago had granted three
weeks time to comply with and the deadline expired on November 2 last. However,
with a view to giving more time to the authorities, the bench said it was granting
time till tomorrow (Nov 7).

The matter relates to acquisition of petitioners’ land in Koyambedu. When the


petitioners took up the matter to the court, the division bench, after verifying the
records, found that the land was not used for the purpose for which it was acquired
and the same should be re-conveyed. This order was challenged before the Supreme
Court, which dismissed and the review petition was also dismissed. Even then, the
government authorities were not prepared to comply with the orders of the court,
the bench pointed out.
The court should not be at the mercy of the State for implementation of its orders.
In case the order passed by this court is not complied with by the State in spite of
confirming the same by the SC, the citizen would lose faith and this court is flooded
with contempt petitions. “We are not aware as to whether the chief secretary is in
the know of things with respect to this sorry state of affairs,” the bench added and
ordered their appearance.
