WHEREAS, flow of traffic in the roads of the Municipality, including the national highway
become perennially difficult due to presence of certain obstructions such as utilizing the shoulders
of the highway and other local roads as parking areas for the customers of commercial
establishments, presence of permanent vendors on the road sides, and over extended terminal
spaces of tricycle association, among others;
WHEREAS, Executive Order No. 621, Series 1980 (Amended EO 113, s. 1955) …National roads
shall have a right of way not less than twenty (20) meters, provided that such minimum width may
be reduced at the discretion of the Minister of Public Highways to fifteen (15) meters in highly
urbanized areas, and that a right of way of at least sixty (60) meters shall be reserved for roads
constructed through unpatented public land and at least one hundred twenty (120) meters reserved
through naturally forested areas of aesthetic or scientific valued;
WHEREAS, Department Order No. 73 Series of 2014 states further the prohibition of usage
within the Right-of-way of National Roads;
WHEREAS, utilizing the shoulders of the national highway as parking lot is prohibited under the
National Highway Act (PD No. 17) and National Building Code (PD No. 1096) and obstructing
the free flow of traffic is illegal under Municipal Ordinance No. 04-97 (Municipal Traffic code),
as amended, Municipal Ordinance 29-2016, as well as Municipal Ordinance No. 10-2012;
WHEREAS, the General Welfare Clause, of the Local Government Code 1991 authorizes every
local government unit to enact such measures that will enhance the public health, safety,
convenience, maintain peace and order and promote the general prosperity of its inhabitants.
4. Assist the Building Official or his personnel on removing or dismantling all stalls
of vendors that are permanently occupying the shoulders of the highway and
shoulders of local roads that tend to encroach the road;
7. Prohibit the use of roads or shoulders of national, provincial and municipal roads
as solar dryer for palay and other agricultural crops, and
8. Ensure that traffic enforcers are at their designated areas of assignment to enforce
the necessary traffic regulations and to issue traffic citation tickets to violators.
1. Punong barangay shall not issue barangay permits or endorsement for business
permit to all applicants/operators of videoke or refreshment bars, carinderias,
restaurants, and similar establishments located along the national highways and
municipal/barangay roads when these establishments lack ample parking space for
their customers. Endorsement issued, if any, shall be subject to
approval/disapproval of higher authorities.
2. Punong barangays are hereby tasked to disseminate the regulations imposed under
this executive order to their respective constituents.
1. The Building Official shall not approve/sign the application for business permit
(occupancy permit)- whether new or renewal of all local business establishments
(videoke bars, refreshment stores, carinderia, restaurants and others whose
customers tend to stay for longer hours, if these establishments lack ample parking
space for their customers or are not compliant with the requirements/pertinent
provisions of the National Building Code.
2. The Building Official or his personnel shall lead in the implementation of this
Executive Order.
This Executive Order takes effect immediately and will remain valid until rescinded in
writing by the undersigned.
