JUDICIAL AFFIDAVIT

I, KAREN MANANSALA LATUMBO, of legal age,


married, Filipino and resident of No. 08 Brgy. Sta. Cruz,
Arevalo, Iloilo City, after having been sworn to in accordance
with law and after having been examined by Atty. Ma. Fe
V. Hojilla of HOJILLA and Associates Law Offices in
Suite M-7, 2nd Floor, Rosary BuildingCor. Quezon- Gen.
Luna Streets, Iloilo City, do hereby depose and state that:

PURPOSE: The testimony of the Witness is offered to


prove the facts leading to the filing of this instant Petition.
The Witness will also testify on such other matters which are
relevant to this case. The Witness will also identify
documents such as this instant Petition, Certificate of Death
and Last will and Testament of CARREY MANANSALA
WHOOPS. Further, the Witness will also identify such other
documents that are relevant to this instant Petition.
Question No. 1 (“Q1”): Please be informed that this
examination is under oath and that you may face criminal
liability for false testimony or perjury, should you not tell the
truth. Do you understand, Madam Witness?

Answer (“A”): Yes, ma’am. I understand.

Q2: Madam Witness, what brings you to this Honorable


Court?

A: I am the Petitioner of this present case, ma’am.

Q3: Could you recall having executed a document in


connection with this case?
A: Yes, ma’am. I filed a Petition before this Honorable Court.

Q4: If this Petition will be presented to you, will you be able


to identify the same?
A: Yes, ma’am.

Q5: I have here a four (4)-page Petition dated October 4,


2013. Is this document familiar to you?
A: Yes, ma’am. That is the Petition that I was referring to.

Q6: On the fourth (4th) page of this Petition is a document


entitled Verification and Certification is a signature above the
name Karen Manansala Latumbo. Is this signature familiar to
you?
A: Yes, ma’am. That is my signature.
Q7: Have you gone over and read the allegations contained
in this Petition?
A: Yes, ma’am.

Q8: Do you affirm and confirm to the truthfulness and


veracity of the allegations contained in this Petition?
A: Yes, ma’am.

COUNSEL: May I request this Honorable Court that this


Petition dated October 4, 2013 which was identified and
authenticated by this Witness be marked as Exhibits “A” for
the first (1st) page, “A-1” for the second (2nd) page, “A-2”
for the third (3rd) page and “A-3” for the fourth (4th) page,
entitled Verification and Certification. May I also request that
the signature of Witness-Petitioner appearing on the fourth
(4th) page of this Petition entitled Verification and
Certification where she authenticated earlier be also marked
as Exhibit “A-4”.

Q9: Madam Witness, do you know the Testatrix of this


present case?
A: Yes, ma’am. The Testatrix Carrey Manansala Whoops is
my older sister and I am living together with her at No. 08
Brgy. Sta. Cruz, Arevalo, Iloilo City.

Q10: Could you tell this Honorable Court what transpired, if


any, on November 12, 2012?
A: Yes, ma’am. Sometime on November 12, 2012, I was
present and witnessed my sister Carrey Manansala Whoops
executed her last will and testament where she instituted me
as her executor.
Q11: Do you have proof, if any, of such a fact?
A: Yes, ma’am. I have a copy of the said Last Will and
Testament of my sister.

Q12: If such document will be presented to you, will you be


able to identify the same?
A: Yes, ma’am.

Q13: I am showing to you a copy of Carrey Manansala


Whoops’s Last Will and Testament dated November 12,
2012. Is this document familiar to you?
A: Yes, ma’am. That is the Carrey Manansala Whoops’s Last
Will and Testament that I was referring to earlier.

COUNSEL: May I request this Honorable Court that Last Will


and Testament dated November 12, 2012 of Carrey
Manansala Whoops which was identified by this Witness and
was previously attached to this Petition as Annex “B” be
marked as Exhibit “C”.

Q14: Appearing on the third (3rd) page of this Last Will and
Testament are the signatures above the name Carrey
Manansala Whoops, Rushelle B. Parcon, Wilma M. Lagance,
and Anna Jade L. Granada and signatures on the left margins
of first (1st), second (2nd) and fourth (4th) pages. Are these
signatures familiar to you?

A: Yes, sir. Those are the signatures of the testatrix, Carrey


Manansala Whoops, and her attesting witnesses, Rushelle B.
Parcon, Wilma M. Lagance, and Anna Jade L. Granada.
Q15: How were you able to know that those are the genuine
signatures of the testatrix decedent Carrey Manansala
Whoops?

A: I am very familiar with Carrey Manansala Whoops’s


signature and that one is her customary signature aside from
the fact that she is my sister; I am present when she signed
the document.

Q16: I am turning it to page three (3). There is a signature


above the name Carrey Manansala Whoops, do you
recognize it?
A: Yes ma'am. That is the signature of my late sister she
affixed last November 12, 2012.

Q17: I am turning the same document on its first (1 st),


second (2nd) and fourth (4th) pages. Do you recognize any
signatures affixed therein?
A: Yes ma'am, I do recognize my late sister’s signature. It is
the first signatures located in the left margin of the first (1 st),
second (2nd) and fourth (4th) pages of the said Last Will and
Testament.

COUNSEL: At this moment, may I request this Honorable


Court that the signatures identified and authenticated by
herein Witness be marked as Exhibits “D” for the third (3rd)
page, “D-1” for the first (1st) page, “D-2” for the second
(2nd) page and “D-3” for the fourth (4th) page.

Q18: Further, how were you able to know that those, really
are, the true signatures of Carrey Manansala Whoops’s
attesting witnesses?
A: I am also familiar with the signatures of Rushelle B.
Parcon, Wilma M. Lagance, and Anna Jade L. Granada for the
said document was signed by all of them in my presence.

COUNSEL: May I request this Honorable Court that the


signatures of the testatrix Carrey Manansala Whoops’s
attesting witnesses which was also identified by this Witness
as be marked Exhibits “E”, “F”, and “G”, respectively.

Q19: What happened after, if any?


A: Ten (10) months after my sister executed such last will or
on September 23, 2013, my sister died.

Q20: Do you have proof, if any, of such a fact?


A: Yes, ma’am. I have a copy of Carrey Manansala Whoops’s
Certificate of Death.

Q21: If such document will be presented to you, will you be


able to identify the same?
A: Yes, ma’am.

Q22: I am showing to you a copy of the Certificate of Death


which was issued by the Office of the Civil Register General.
Is this document familiar to you?
A: Yes, ma’am. That is the Death Certificate of Carrey
Manansala Whoops that I was referring to earlier.

COUNSEL: May I request this Honorable Court that this


Certificate of Death of Carrey Manansala Whoops which was
issued by the Office of the Civil Register General and which
was identified by this Witness and was previously attached
to this Petition as Annex “A” be marked as Exhibit “B”.

Q23: What happened then, if any?


A: When my sister executed the said will, she signed the
document together with RUSHELLE B. PARCON, WILMA
M. LAGANCE, and ANNA JADE L. GRANADA.

Q24: Who are these persons that you have just mentioned?
A: They are the witnesses when the decedent Carrey
Manansala Whoops executed the will which is the subject of
this instant Petition.
Q25: Now, the documents you have just presented are only
photocopies of the original documents. What happened to
the original documents, Madam Witness?
A: Ma’am, I have the originals for reference with the
photocopies.

Q26: Now, Madam Witness, do you have anything else to tell


this Honorable Court, if any?
A: Yes, ma’am. Because of these circumstances and for the
fact that I am the one instituted by the Testatrix, my late
sister, Carrey Manansala Whoops, I am praying to this
Honorable Court that the abovementioned will be admitted
to probate and that letters testamentary (or of
administration) be issued without bond.

Q27: What else, if any?


A: No more, ma’am.
I am executing this foregoing Judicial Affidavit to attest
to the truth and veracity of the allegations contained herein.

IN WITNESS WHEREOF, I have hereunto set my hand

The affiant, whose name and personal circumstances


are stated above, personally appeared before me this 23rd
day of October 2013 in the City of Iloilo, Philippines,
presented the foregoing Judicial Affidavit, signed the same in
my presence and affirmed under oath to the correctness of
the contents or allegations of the same.

The affiant was identified by competent evidence of


identity, namely a TIN 321-654-987 bearing her
