PRESS RELEASE

1. Following the issuance of Notification No.MD/PSRA/3-1/_____ dated 06.09.2019

this office has been approached by potentially affected persons/parties to
elaborate/particularise whether the charging of fee by private schools
during the summer vacations is permissible/lawful.

2. It is hereby clarified that; through the issuance of Notification No.MD/PSRA/3-

1/_____ dated 06.09.2019, the P.S.R.A has merely affirmed that the Notifications
enumerated therein were issued without lawful authority. The prohibition to
demand, charge and/or collect any sort of fee (including summer vacation fee)
emanates from the order dated 06.09.2019 of the Honourable Peshawar High
Court passed in Writ Petition No. 3536-P/2019 and the said order holds the
field, in spite of the issuance of Notification No.MD/PSRA/3-
1/_____. Relevant part of the order of the Peshawar High Court is
reproduced below:

“In the meanwhile all the Respondents are restrained from charging any sort
of fee from the students till the date fixed”.

3. So long as the afore-reproduced injunctive order holds field (as it presently

does), it is illegal for private schools to demand, charge and/or collect any
sort of fee (including summer vacation fee). The next date of hearing of
Writ Petition No. 3536-P/2019 and connected Writ Petitions is 24.09.2019.

4. In view of the foregoing legal position all stakeholders are directed not to make
any fee payments to private schools and promptly report any private school
demanding and/or charging any sort of fee (including summer vacation fee) to the
P.S.R.A so that those schools may be dealt with in accordance with law.
