INTRODUCTION
Article 370 is arguably the most contentious provision of the constitution of India. It deals
exclusively with the Jammu and Kashmir State that came under the administrative control of
the Government of India after the country’s 15- month war that Pakistan started in 1947 to
seize sovereignty over the state. Besieged by the controversy right from tits draft stage,
Article 370 has been the subject of heated debate ever since the Constitution came into full
effect from 26th January 1950.The President had used his powers under Article 370 to
fundamentally alter the provision, extending all Central laws, instruments and treaties to
Kashmir.
