POSITION PAPER OF ANTI DISCRIMINATION LAW

Anti-discrimination or non-discrimination law relates to legislation aimed at preventing

discrimination against specific groups of individuals, these groups are often referred to as
protected groups or protected classes.
According to my research Anti-discrimination regulations differ by jurisdiction with respect to
the kinds of discrimination that are for bidden, as well as the organization that are protected by
the law. These kinds of laws are commonly intended to avoid discrimination in jobs, housing,
education, and other fields of social life, such as government housing. Anti-discrimination law
may include sex, age, race, ethnicity, nationality, disability, mental illness or capacity, sexual
orientation, gender, sexuality identity / expression, sexual characteristics, religious, creed, or
individual political opinions. Anti-discrimination laws are rooted in equality values specifically
that owning to the features described above, people should not be treated differently. Anti-
discrimination legislation are intended to safeguard against both person (individual)
discrimination and structural discrimination (due to policies or processes that disadvantage
certain groups). In determining whether a particular action or policy constitutes discrimination,
courts cab take in to account both discriminatory intent and disparate impact.
Discrimination is treating, or proposing to treat, someone unfavorably because of a personal
characteristic protected by the law. This includes bullying someone because of a protected
characteristic.
The Equal Opportunity Act 2010 – Philippines anti-discrimination law – protects people from
discrimination and harassment in areas of public life such as workplaces, schools, clubs, shops or
places that provide services

Types of discrimination
You can be discriminated against directly or indirectly. In Victoria it is against the law for
someone to discriminate against you because of a characteristic that you have, or that someone
assumes you have.
These personal characteristics include:
Age, career and parental status, disability (including physical, sensory and intellectual disability,
work related injury, medical conditions, and mental, psychological and learning disabilities),
employment activity, gender identity, lawful sexual activity and sexual orientation, industrial
activity, marital status, physical features, political belief or activity, pregnancy and breastfeeding,
race (including color, nationality, ethnicity and ethnic origin), religious belief or activity, sex,
expunged homosexual conviction, personal association with someone who has, or is assumed to
have, one of these personal characteristics.
It is also against the law to sexually harass or victimize someone, or to vilify someone because of
their race or religion.

INTRODUCTION
In today’s generation, discrimination is very popular in our society. Being discriminate can cause
losing confidence in a self of individual,
The government implemented the law of anti-discrimination in order we are all free to express
ourselves. According to President Duterte, the enchantment of law against discrimination of sex
or sexuality does not find any issue. Yet, according to his spokesperson, duterte will not approve
the sexual orientation, gender identity and expression (sogie) equality bill in congress as urgent,
preferring a general anti-discrimination law instead. Despite the event involving a transgender
woman, Gretchen diez, an accosted transgender woman attempting to use a female toilet in a
Quezon City shopping mall, duterte suggested toilet separation for males, females, gays, and
lesbian. This way, he said, each sex will be able to relieve themselves in their respective toilets.
The State recognizes every person’s fundamental rights to be free of discrimination, regardless of
sex, age, class, status, ethnicity, color, disability, religious and political beliefs, sexual,
orientation or gender identity. Therefore, it will intensify its effort to fulfill its duties under
international and domestic laws to respect, protect and fulfill every individual’s rights and
dignity.

Sexual orientation or sex identity discrimination continues to occur in many areas of the globe,
highlighting the need for regulations to safeguard the LGBTQ+ community.
In the Philippines, on the grounds of sexual orientation and gender identity, only 20 local
government units have ordinances against discrimination LGBTQ+, but it was in a mall in that
city where Gretchen diez, a trans woman was discriminated against – an incident that fuelled
discussions on the SOGIE bill for equality.
Sogie or sexual orientation and sex identity and speech acknowledges human sexuality’s variety
and its many types of speech as a word in itself. Then boxing the discussion from the ' male
versus female rights ' view already highlights some of the problems that the Sogie Equality Bill
seeks to tackle.
As a student it is okay for me to have a own restrooms, the people who part of the LGBTQ+ so
that we can avoid some people who judge them, saying bad things about them just like what
happen to Gretchen diez I know some people that part of the LGBTQ+ do not want to experience
that kind of treatment that Gretchen diez experiencing, we are all equal we deserve some respect
also the part of LGBTQ+.
According to ABS-CBN NEWS Transgender woman Gretchen Diez counts herself lucky to be
given the opportunity to become the face of the LGBTQ+ community movement despite the negative
backlash.

"I think what happened to me, the exact narrative and the video I posted online is an exact
representation of how we are being viewed in society," Diez said.

CONCLUSION
Base on my searching In 29 states, you can legally be fired or even kicked out of your house
because of your sexuality. My possible solution is to propose that laws be put in place,
preventing sexuality-based discrimination. This would stop people from firing LGBTs solely
because of their sexuality. It would also prevent housing discrimination against LGBTs. My
solution will positively impact this problem because these laws will ensure that people are no
longer treated unfairly in legal issues because of people's beliefs. Anti-discrimination laws will
also encourage the belief that people can't change who they are, and the laws will remind us that
it isn't okay to discriminate.

We accept as true with that the biggest purpose human beings are bullied due to the fact of their
sexuality is because of lack of education. Peers of LGBT human did not develop up with the
thought of LGBT, and so they see it as unnatural and it makes them uncomfortable. Our
neighborhood answer is really campaigning. This solution can take many exceptional forms and
has been tried in the past, examples being the “It Gets Better” campaign and “The Trevor
Project”. Campaigns like this have been fine so far. They help raise people's awareness, and
promote LGBT equality. Two if we campaign LGBT rights, we will elevate others' cognizance
of the issue. If youthful kids develop up understanding about LGBT, then there is much less of a
danger of them wondering it is unnatural? People research the most at a younger age, and we
cannot maintain hiding the LGBT issue from our children. The inequality won't go away, so we
may as properly strive to equalize it.

I would like to add a new article to The Universal Declaration of Human Rights mentioning the
equal rights for LGBTs. two this article would detail that homosexuals
have precisely the equal rights as heterosexuals at some stage in the world.
Although international locations are now not required to observe these articles, it would be
the fantastic starting place for change. In the past, articles have been delivered for the equality of
women. Two although many nations are nonetheless discriminating against women, the UN units
functionary aim for governments to work towards. Two Having pointers for
these countries is helping to make progress for rights at some stage in the world, making it a top
of the line way to pave change.
This position paper is a report describing a topic, my country's position, and possible solutions.
The purpose of a position paper is to generate support on an issue. It describes a position on an
issue and the rational for that position. The position paper is based on facts that provide a solid
foundation for my argument. I made this position paper to support the people who experiencing
discrimination and to wake people up that we are all equal that all the people even the part of
LGBTQ need also a respect.
