Whether or not a crime of rape happened in the rice field near Mario’s house.

In a transcript dated October 8, an alleged raped happened on June 12 at 11 p.m. the parties
involved are Julia Torres, eighteen years of age, and a resident of Barrio Talaan, Lian and Ronald
Galang, twenty years of age, also with the same residence as the victim, Julia Torres and also her
suitor. The contention of Torres is that on June 12 she went to the house of Celia on their barrio to
attend a wedding party and saw Galang there. During the wedding party, they were in high spirits
and had a good time because a lot of friends are met. On the occasion of the wedding party and
when the spirits were high, Ronald tried to talk to Julia but she ignored and stayed away from him
because she disliked him for a suitor. Julia took a leave at 11 p.m. and started walking home alone
and took a short cut across Mario’s farm in the direction of her house. As she was walking alone,
Ronald approached her and requested that he walked her home. Julia declined the offer of Ronald
and doubled her steps but Ronald caught her arm and wrestled her to the ground. Julia struggled
to get free but Ronald pointed a knife at her side and threatened to stab her if she will call for help
or persisted in fighting back. Julia only reported the incident after two days because of the fear of
the trouble that will happen to her parents and brothers if found out.
In a transcript dated October 16, on the defense of Ronald Galang, he contested that he did
not rape her but only had a sexual relationship on the evening of June 12. They were sweethearts
for over two months before the incident happened on June 12. On the evening of the wedding
party, things went well and he had fun meeting his friends. But because of the jokes of his friends
that Ronald has some other girl, Julia became furious and refused to talk to Ronald. When the
wedding party ended, he walked alongside Julia and tried to explain the jokes played by his friends
and after a while, he convinced her to sit on a piece of log near the house of Mario. The evening
was romantic and eventually they reconciled, they kissed and embraced each other and forgetting
themselves and made love on the grass. Ronald alleged that Julia freely agreed to make love on
that night and supporting the medical report of the medical examiner that Julia’s vaginal canal had
lacerations were because Julia was a virgin and she bled during their romantic evening. After the
event happened that night, Julia insisted to marry her because she was afraid, she might have
become pregnant. Ronald declined Julia and asked to wait for a while. Julia then became angry
and threatened to complain to her parents that he raped her but Ronald still refused to marry her
right away.
In a transcript dated October 25, on the witness statement made by Mario Perez, the owner
of the farm where the incident happened, on that evening on June 12. That the farm was not so
dark because the moon shone brightly in the sky and during the time Mario is watching over his
sick daughter, he remembered no outcry of a woman somewhere outside his house. After
interviewing the witness, the defense counsel rests the case.
