Plea Bargaining Qualified Trafficking and Child Pornography
Section 15. Penalties and Sanctions. - The following penalties and sanctions are hereby
established for offenses enumerated in this Act:
(h) Any person found guilty of violating Section 4(k) of this Act shall suffer the penalty of prision
correccional in its medium period and a fine of not less than One hundred thousand pesos
(php100,000.00) but not more than Two hundred fifty thousand pesos (php250,000.00);
(i) Any person found guilty of violating Section 4(l) of this Act shall suffer the penalty of
arresto mayor in its minimum period and a fine of not less than Fifty thousand pesos
(Php50,000.00) but not more than One hundred thousand pesos (Php100,000.00);
WHAT ARE THE BASIC REQUIREMENTS OF PLEA BARGAINING? The following are the
requirements set forth by the Rules upon which plea bargaining may be made: a. It should be
with the consent of the offended party and the prosecutor; b. The plea of guilt should be to a
lesser offense; and c. The lesser offense must necessarily be included in the offense charged.

Plea bargaining act of 2011 which limits 2 degrees lower penalty has not become into a law.
