PLA, Ch2, Sec 3 SECTION 3 1 General 1.1. Discontinuance of class aaa 1/1/2019) he class may be discontinued either temporarily or perma- rently. In the former case, itis referred to as "suspension’ of class, in the latter case as ‘withdrawal’ of class. In both ceases, the class is invalidated in all respects. Withdrawal, suspension and reinstating of class are confirmed in writing by the Society to the Owner and to the flag Administration, 1.2. Suspension of class 121 (1/1/2019) ihe class may be suspended either automatically or fllow- ing the decision of the Society. Automatic suspension operates as from the date on which the circumstances causing the suspension occur Suspension following decision of the Society takes effect from the date when the conditions for suspension of class are met Suspension of class will remain in effect until such time as the class is reinstated once the cause giving rise to suspen- sion has been removed, subject to any additional surveys that the Society deems necessary taking into account the condition of the ship and the cause of the suspension, In any event, the ship will be considered as not retaining its class from the date of suspension until the date when class is reinstated irespective of the date of the confirmation in ‘writing pursuant to [11.1] 1.2.2 1/1/2019) The class is automatically suspended, in addition to the ccases contemplated in [1.2.3], [1.2.4] and [1.2.5], when ‘one ar more ofthe following circumstances occur: ‘+ when a ship is not operated in compliance with the rule requirements, such a¢ in cases of services oF conditions not covered by the service notation, or trade outside the navigation restrictions for which the class was assigned ‘+ when a ship proceeds to sea with less freeboard than that assigned, of has the freeboard marks placed on the sides ina position higher than that assigned, of in cases of ships where freeboards are not assigned, the draught is greater than that assigned ‘+ when the Owner fails (o inform the Society in order to submit the ship to a survey after defects or damages affecting the class have been detected ‘+ when repairs, alterations or conversions affecting the class ate carried out either without requesting. the attendance of the Society oF not tothe satisfaction of the 102 SUSPENSION AND WITHDRAWAL OF CLASS Surveyor. For voyage repairs reference is to be made to Sec 2, 12.111 ‘+ when a ship undergoing a survey resumes trading before completion of the same survey or before pending items are dealt with 1.23 Suspension and reinstatement of class in the case of overdue class renewal survey (1/1/2019) ‘The 5-year Cerificate of Classification expires and classifi cation is automatically suspended from the certificate ‘expiry date in the event that the class renewal survey has not been completed or is not under attendance for compl tion, by the due date, but notwithstanding the above, Classi- fication will be automatically suspended if the ship resumes trading prior to completion. Classification will be reinstated upon satisfactory comple tion of the surveys due. The surveys to be cartied out are to bbe based upon the survey requirements at the original date due and not on the age of the vessel when the survey is cae fied out. Such surveys are to be credited from the date orig inally due, Under "exceptional circumstances, as defined in Sec 2, [2.1.7], the Society may grant an extension ot exceeding three months to allow for completion of the class renewal survey provided that the ship is attended and the atending Surveyor(s)s0 recommends) after the following have been carried out a) annual survey; by re-examination of recommendations; ©) progression of the class renewal survey as far as practi= cable. Inthe case where dry-docking is due prior to the end of the class extension, an underwater examination isto be carried ‘out by an approved diving company. An underwater exami- nation by an approved company nay be dispensed with in the case of an extension of the dry-dacking survey not ‘exceeding 36 months provided the ship is without outsland- ing recommendations regarding underwater parts. If the Ceniicate of Classification will expire when the ship is expected to be at sea, an extension to allow for comple tion of the class renewal survey may be granted provided that there is documented agreement to stich an extension prior to the expiry date of the certificate, that satisfactory arrangements have been made for attendance of the Sur. veyor atthe first port of call, and that the Society is satisfied that there is technical justification for such an extension, Such an extension is to be granted only until arrival at the first port of call after the expiry date of the certificate. How- fever, if owing to “exceptional circumstances’ the class renewal survey cannot be completed at the first por of call the procedure given above in cumstances" may be followed, but the total period of exten- sion is in no case to be longer than three months after the ‘original due date of the class renewal survey. 1.24 Suspension and reinstatement of class in the ase of overdue intermediate survey (1/1/2019) “The Certificate of Classification becomes invalid, and classi- fication is automatically suspended, if the intermediate sur- vey has not been completed within three (3) months of the due date of the third annual survey in each periodical sur- vey cycle, unless the ship is under attendance for comple- tion of the intermediate survey but notwithstanding the above, classification will be automatically suspended i the ship resumes trading prior to completion Classification will be reinstated upan satisfactory comple- tion of the surveys due. Such surveys are to be credited from the date originally due. 1.2.5 Suspension and reinstatement of class in the ease of overdue annual survey (1/1/2019) “The Certificate of Classification becomes invalid, and classi« fication is automatically suspended, ifthe annual survey has not been completed within three (3) months of the due date of the annual survey, unless the ship is under attendance for completion of the annual survey but notwithstanding the above, Classification will be automatically suspended! i the ship resumes trading prior to completion Classification will be reinstated upan satisfactory comple- tion ofthe surveys due. Such surveys are to be credited from the date originally due. 1.2.6 Suspension of class in the case of overdue continuous survey item(s) (1/7/2005) Continuous survey items) due or overdue atthe time of the annual survey is (are) to be dealt with. The ship's class will be subject to a suspension procedure ifthe itens) is fre) not surveyed or postponed by agreement. 1.2.7 Other cases of suspension of class (1/1/2019) In addition to the circumstances for which automatic sus- pension may apply, the class of a ship may also be sus- pended following the decision of the Saciety + when one or more surveys are not held by their limit dates -see Sec 2, [2.1.4]- or the dates stipulated by the Society also taking into account any extensions granted in accordance with the provisions of Patt A + when, due to reported defects, the Society considers that a ship is not entitled to retain its class even on a temporary basis (pending necessary repairs or renewals, ete) + in other circumstances which the Society will consider fon their merits (ein the event of non-payment of fees or where the Owner fails to subject the ship to the occa- sional survey as per the requirement in Sec 2, [11.2.1)} 12. Laid-up ships (1/7/2009) Ships laid-up in accordance with the requirements indi cated in Sec 2, 13.1.1] prior to surveys becoming overdue INA Rules 2018 PLA, Ch2, Sees reed not be suspended when surveys addressed above become overdue. However, ships which are laid-up after being suspended as a result of surveys going overdue, remain suspended until the overdue surveys are completed. 1.29 Voyage to demolition (1/7/2005) When itis intended to take a ship on a demolition voyage with any periodical survey overdue, the ship's class suspen- sion may be held in abeyance and consideration may be given to allowing the ship to proceed on a single direct bal- [ast voyage from the lay-up or final discharge port to the clemolition yard. In such cases a short-term Certificate of Classification with conditions for the voyage nated may be issued provided the attending Surveyor finds the ship in sat- isfactory condition to proceed on the intended voyage. 1.240 Force Majeure (1/7/2014) ‘due to circumstances beyond the Owner's or the Soci ety’s control, as defined in Sec 2, [2.1.8], the ship is notin a port where the overdue surveys can be completed at the expiry of the periods allowed above, the Society may allow the ship to sail, in class, directly to an agreed disharge port, and if necessary, from there, in ballast, fo an agreed port at which the survey will be completed, provided the Society a) examines the ship's records; by carries out the due and/or overeue surveys and exami= nation of recommendations atthe first port of call when there is unforeseen inability of the Society to attend the ship in the present port, and has satisfied itself that the ship is in condition to sail for tone trip to a discharge port and subsequent ballast voy- age to a repair facility if necessary. (Where there is unforeseen inability of the Society to attend the ship in the present port, the Maser is to confirm that his ship is in condition to sail to the nearest por of call) The surveys to be carried out are to be based upon the sur. vey requirements at the original date due and not on the age of the vessel when the survey is carried out. Such sue veys are to be credited from the date originally due. If class has already been automatically suspended in such cases, it may be reinstated subject to the conditions pre- scribed in this item, 1.2.11 Single voyage for repair of laid-up ships (1/7/2013) When a ship is intended for a single voyage from laid-up position to repair yard with any periodical survey overdue, the ship's class suspension may be held in abeyance and consideration may be given to allowing the ship to proceed ‘on a single direct ballast voyage from the site of lay-up to the repair yard, upon agreement with the Flag Administra tion, provided the Society finds the ship in satisfactory con- dition after surveys, the extent of which are to be based on surveys overdue and duration of lay-up. A short-term Class Cerificate with conditions for the intended voyage may be issued. This is not applicable to ships whose class was already suspended prior to being laid-up, 103 PLA, Ch2, Sec 3 1.2.12. Suspension and reinstatement of class in the case of overdue recommendations (1/1/2019) ach recommendation will be assigned a due date for com= pletion, The ship's class will be subject to a suspension pro- cedure if the recommendation is not dealt with, or postponed by agreement, by the due date. Classification will be reinstated upon verification that the ‘overdue recommendation has been satisfactorily deal with 1.2.18 Suspension and reinstatement of class of dual classed vessels (1/1/2019) When a ship is dual classed and in the event that the Soci= ety takes action to suspend the class of the vessel for techni- cal reasons, the Society will advise the "Other Society" (see Note 1) of the reasons for such action and the full circum- stances within five (5) working days, I the Society is advised that the "Other Society" has sus- pended the class for technical reasons, the Society will, upon receipt of this advice, also suspend the class of the vessel, unless it can otherwise document that such suspen sion is incorrect When the Society decides to reinstate class, itis to inform the “Other Society’ Note 1: "Other Society’ means, the other classification Society \which i involved inthe ual clas. 1.3. Withdrawal of class 1 1 (1/1/2019) ‘The Society will withdraw the class of a ship in the follow- ing cases: ‘+ atthe request of the Owner ‘+ when the causes that have given rise fo a suspension currently in effect have not been removed within six months of the date of suspension, However, the Society may withdraw the class ofthe ship before the end of the six-month period where it deems it appropriate, A longer suspension may be granted at the Societys dis- cretion when the ship is not trading as in cases of lay- Up, awaiting disposition in the case of a casualty or attendance for reinstatement ‘+ in case of transfer of ownership when the requirements under Sec 2, [12.1.1] are not complied with ‘+ when the ship is reported as a constructive total loss + when the ship is lost “+ when the ship is reported serappeed. Withdrawal of class takes effect from the date on which the circumstances causing such withdrawal occur. 104 1.3.2 When the withdrawal of class of a ship comes into effect, the Society will + forward the Owner writen notice + delete the ship from the Register of Ships + notify the flag Administration + make the information available to the Underwriters, at their request. 1.4 Reassignment of class following class withdrawal 14a (1/1/2019) At the request of the Owner, a ship which was previously classed with the Society, subsequently withdrawn from class and that has not been further classed ie + has never resumed its rade + has not been classified by any other Classification Soci ey ray have the class reassigned but the Society shall have the right to decline an application for re-assignment of class 142 (1/2018) The reassignment of Class may take place upon satisfactory: + removal ofthe causes that led to class withdrawal + execution of the surveys expited during the period of class withdrawal + verification of additional ascertainments as_deemed necessary by the Society according to the provisions of Ch 3, See 2, 14.1 “The new period of Class and the validity ofthe Certificate of, Classification will be considered by the Society on a case by case basis. nal 1.5 Suspension/withdrawal of ad class notations 1.81 If the survey requirements related to maintenance of additional class notations are not complied with, the sus- pension or withdrawal may be limited to the notations con- cemed ‘The same procedure may apply to service notations of ships which are assigned with more than one service notation, 1.8.2. The suspension of withdrawal of an additional class notation or a service notation (where a ship is assigned with more than one service notation) generally does not affect the class
