business.
ITS can rely on us to propose our best offer in order to win projects in Indonesia and especially this one .

So, you can consider a 4% discount on AHT side and the following alternative payment terms proposal :

5% to be paid at drawings delivery,

85% at FCA port delivery date,

10% at provisional acceptance certificate issuance , not later than 12 months from FAT date.

Could you please let us know the complete project completion time and milestones data in order to
analyse your request.

We need to have :

Contract award date, exp. February 2010

TOC date, February 2011

FAC date, July 2011.

What do you mean by 90% progress ? FOB delivery ?

85% of total amount 90% will be paid while material arrive at site .

15% of total amount 90% will be paid while material installed .

Dear Colleagues,

Please be informing that we would like to bid 275kV Binjai S/S and this is ITS Target project as a key to
enter in 275kV network in PLN.
The project will be finance by PLN own fund (APLN) with 0% Down Payment .
Base on our experience for several on going APLN projects , we have tried to negotiate with PLN during
CDA to get DP but PLN refused as this is in accordance to PLN Board of director regulation . We have no
choice otherwise we will reject ...
In regard to the above, we would like to apply back to back condition of TOP to you as mention in the
bidding document below and request you to accept in your proposal .

Down Payment = 0%.

0%.
Progress = 90%
TOC = 5%
FAC = 5%

In addition to the above, please also be informing that we are now in the final stage of our costing and the
result we still 4% above the target price.
We once again request you to review your price and confirm to give at least 4% discount

Please note: our competitor Siemens will be very aggressive to get this project , since they have got
experience in 275kV network. (They have signed the contract 275kV Simangkuk S/S last August'09).

Your confirmation to the above request would be appreciated and waiting for your feedback today .
