CHILD WELFARE COMMITTEE (IV) MAYUR VIHAR VISIT REPORT

The CHILD WELFARE COMMITTEE is constituted in accordance with the provisions


under section-27 of the Juvenile Justice (Care and protection of Children) Act 2015, and read
with rule-15 of the Juvenile Justice (Care and protection of children) Model rules 2016 in
each and every Districts by the State Govt. for exercising the powers and to discharge the
duties, conferred on such committees in relation to children in need of care and protection
under this Act and Rule.

COMPOSITION AND FUNCTIONING-


We had visited CHILD WELFARE COMMITTEE Mayur Vihar Dated 21.06.2019 regarding
the” Project of working of CHILD WELFARE COMMITTEE” The Mayur Vihar CHILD
WELFARE COMMITTEE had a Composition of a Chairperson named RENU LOVE and
the three Members.

The Chairperson has a Social work qualification background while the other member MISS
MEERA is a Clinical psychologist. The Rest of the member also posses a Social work
educational background, The official working hours of the committee is MON-FRI from 10
AM -) 5 PM. Saturday and Sundays are weekly off days but in the case of workload or
exceptional cases the CHILD WELFARE COMMITTEE works on Vacation also .

The Chairman along with all its members works in coordination with the other district
CHILD WELFARE COMMITTEE, DCPU as well as the Institutions of the NGO. The time
taken by the CHILD WELFARE COMMITTEE in the disposal of the cases depends on the
Case to Case. The POSCO CASE takes up to 2 years on an average for disposal while the J.J
cases take up to 4 months for disposal.

The CHILD WELFARE COMMITTEE in Delhi are controlled by two pathways one is of the
NCT DELHI whereas the other one is of the Central Government. The minimum time in
handling the case is up to 1 hr. While the Child is rescued by the DCPO and produced before
the CHILD WELFARE COMMITTEE, his counselling and the medical check up is done
.The reports are mentioned in the registers as well as the database. In the case of recognition
of Parents the restoration process is conducted. The Parents are also provided counselling and
after the restoration of Child to them, the follow up of the Child is taken after every 4-6
months up to 1-4 years .In the Case the child is not able to recognise the parents or not able
to tell about parents the Child is sent to the Child Home after his/her counselling .
JURISDICTION
The CHILD WELFARE COMMITTEE is a quasi-Judicial body setup under the provision of
the Juvenile justice act 2105. Normally each District consists of 1 CHILD WELFARE
COMMITTEE along with a no. of Police stations, The aforesaid CHILD WELFARE
COMMITTEE has 21 Police stations.

The CHILD WELFARE COMMITTEE works with Children in need of care and protection in
the Cases of Child labours, Beggars, Missing Child, and in Child Marriages cases .In the
Case Child from another State is rescued and produced before the CHILD WELFARE
COMMITTEE the child is sent to the CHILD WELFARE COMMITTEE of respective origin
District by the Escort.

Follow up of the Child is taken from time to time. The Social investigation report is prepared
in order that if circumstances arise the child must be restored to the parents. The special
Cases of the Children in conflict with the law are produced before the special benches of
Court (Pocso, and Juvenile justice) which is located in Saket. The appeallate authority of the
CHILD WELFARE COMMITTEE are High Court/ Special court(POCSO).

Generally a child is kept up to 18 years in a child home after that he is sent outside but in
special cases such as education and skill development he/she may be kept up to the age of
21.For skill development programs are regularly carried out by DCPO or outer agencies in
order to make the child self capable for living his life,

CASE DISPOSAL

There is no pendency of the Cases. The cases are disposed Time to time depending on the
nature of the Case. The Pocso case takes longer time up to 2 years whereas the Juvenile
Justice, cases take up to 4 months for disposal. The data of the fresh cases are 60-80 in a
month and round up cases are 80-100.Time to time Juvenile justice Board refers 3-4 Cases to
the CHILD WELFARE COMMITTEE.

REPORT TO AUTHORITIES

The CHILD WELFARE COMMITTEE maintains the report of the counselling as well as the
Cases .It also generates monthly/annual report of the Data and provides it to the DCPU,
District Magistrate as well as Ministry Demand,
The District Magistrate pays a visit (via designation) quarterly for monitoring purpose .
She/he also conducts meeting and Training sessions with the members for the smooth
functioning of the CHILD WELFARE COMMITTEE. In case of conflicts with the Police
authorities, CHILDLINE during disposal of Cases the Chairperson Conducts programs of
social interaction with concerned members.

GRIVANCES

The Chairperson complained that the CHILD WELFARE COMMITTEE is facing a huge
lack of staffs. In Such Situation the Proper and Smooth functioning of the CHILD
WELFARE COMMITTEE is affected. The Chairperson said that she has consulted the
authorities of the Ministry of women and Child development regarding this problem but since
a long time the Ministry has not run any recruitment. In absence of data operator staffs the
Data of the Cases like Suo moto, fresh cases are not properly maintained. There is opacity in
the working of management Committee. There is also lack of proper AID/Funds from the
government. Proper Rehabilitation program also needs to be run.

SUGGESTIONS

The Chairperson gave us many suggestions which included as:

 The proper appointment of the staffs.

 The Proper training of the Police authorities must be conducted.

 There must be an induction training program of members conducted before joining


the CHILD WELFARE COMMITTEE.

 The awareness of the J.J Act, Pocso Act and combine dialogue must be conducted
time to time for the smooth functioning of the CHILD WELFARE COMMITTEE.

 The Law and legislations have limited provisions regarding Begging. The provisions
need to be strengthen up.

 Time to time proper meeting must be conducted between the CHILD WELFARE
COMMITTEE and the J.J Board as well as the State government.

 The Child Welfare Committee must be provided with absolute power for maintaining
transparency in Management committee.
CONCLUSION

The CHILD WELFARE COMMITTEE are doing really a fabulous and appreciable work
ensuring the rights of the children in order of maintaining social welfare. But it is facing
some hurdles, like the unavailability of staffs, lack of proper coordination among the CHILD
WELFARE COMMITTEE, authorities and the CHILDLINE. Regardless all these things
everything are working in their proper condition. If all the above discrepancies will be sorted
out the CHILD WELFARE COMMITTEE will run in its best manner..
