PRAYER

Wherefore in the light of Issues raised, arguments advanced and authorities cited, the
counsel on behalf of the Informant, most humbly pray before this Hon’ble Commission
to be pleased to adjudge and declare that:

• The change of terms by BL amounts to abuse of dominant position under Section


4(2)(a).

• There are structural or strategic barriers created by BL in the relevant market.

• BL has leveraged his dominant position in one relevant market to enter into
another relevant market.

• The Agreement Entered Into by Golden Pass with Foreign Brands is Anti-
Competitive and violative of Section 3 of The Act.

• “Gold Pass” as an Agreement Between Golden Spas Violates Section 3 of The


Act.

And to pass any order or relief in favor of the Informant which this Commission
may deem fit in the interest of Justice, Equity and Good Conscience.
