HUMAN RIGHTS AND CRIMINAL JUSTICE SYSTEM: INDIAN SCENARIO

Abstract:

Indian Constitution as represented by various choices of the Supreme Court accommodates the
assurance of human rights incongruity with the global norms. The Human Rights Commission
Act, 1993 accommodates constitution of National and State Human Rights Commissions to
enquire into dissensions of infringement of human rights and wastefulness with respect to the
Government apparatus in avoiding such infringement and to propose measures for compelling
usage of certifications gave by the Constitution and different laws of the nation.

Many Judgments of Hon’be Supreme Court transformed the criminal justice system in India,
from Sunil Batra v. Delhi Administration in which it was held that keeping of under trial
detainees, who are attempted to be pure, with convict’s insults trial of sensibility under Article
19 or decency under Article 21. It is the Supreme Court which changes the criminal justice
system in India but in reality we are still working on a system based on the equity which is
ancient, out of date and abusive, as it goes under substantial feedback when issues of human
rights are raised at a national and universal form. At the point when the feedback originates from
our own human rights activists, researchers, authors, media people, the chieftains of criminal
equity framework keep up attentive hush, yet when the feedback originates from universal
(outsider) sources, similar to Amnesty International, World Watch, and so on there are solid
replies verging on disdainful negligence of claims.

As the wrongdoings have expanded and furthermore their assortment. The expansion in
wrongdoing is a direct result of the consolidated commitment of socio-politico-monetary
components. A few reasons, which can be stated such as the increment in the populace,
increment in the joblessness and refusal of chances to a specific area of individuals.

In the present paper we are also going to discuss the role of police, courts, and penitentiaries. We
are also going to suggest the ways to improve the same.
