From 01.04.2019 To 31.03.2022 india Notification No, == dae CHAPTER =1 Definitions and General Terms and Conditions Definitions ~ General In this Scale of Rates unless the context otherwise roquirs, the following definitions shall apply (@) "Coastal Vessel shall mean any vessel exclusively employed in trading between any port or place in India to any ater port or place in India having a valid costal licence issued by the Competent ‘Authority. (i) “Cold mee” shall mean the movement ofthe vessel without the power ofthe engine of the vessel (iy “Day” shall mean the period starting from 6 am. of «day and ending at 6 a.m, on he following day. (iv) *Foreign-going vessel” shall mean any vessel other than coastal ves (9) "Week" shall mean a continuous period of 7 days () “Hirer” shall mean all users of the port using any ofthe appliances ‘ofthe por. (oi) "Month shall mean the period fom Ist to end ofthe calendar month, (i) "Por shall comprise of al the are within the limits including sea ward lis, (Gx) "Sailing vessels shall mean vessels propelled solely by wind power and includes veses fied with mechanical means of propulsion. (x) “Shift” shall mean shift o 8 hours as applicable to Port employees. Criteria for levy of Vessel Related Charges (VRC) at Concessional Coastal ‘ate and foreign rate (2) In cases of such conversion, coastal rates shall be chargeable by the Toad por from the time the vessel stats loading coastal poods. (©) In cases of such conversion coastal rates shall be chargeable till the vessel completes discharging operations atthe last eall of Indian Port: immediately thereafter, foreign going rates shall be chargeable by the discharge ports. (©) For dedicated Indian coastal vesels having & Coastal licence from the Director General of Shipping no other document willbe required to be entitled to coastal rates, Criteria for levy of Cargo Related Charges (CRC) at Concessional Coastal ate (a) Foreign going Indian Vessel having General Trading License issued for ‘worldwide and coastal” operation should be accorded applicable coastal ates with respect to Handling Charges (HC) i. ship to shore transfer and transfer from/ to quay to from storage yant including harfage inthe following scenario: (© Comerted to coastal run and carying coastal cargo from any Indian Port and destined for any ther Indian Pon. Further, these charges will be collected in Indian Rupees ‘only atthe applicable exchange The cargo / container related charges for all coastal cargofcontiners, ‘ther than thermal coal, POL including Crude Oi, iron ore and iron pallets, should not exceed 60% of the normal cargo/conainer related charges. In case of a Foreign Mag vessel converted to coastal run onthe basis of a Spevified Period License issued by the Director General of Shipping. land a Custom Conversion Order, the coastal cargo container loaded from any Indian Port and destined for any other Indian Port should be levied athe rate applicable for coastal cargo container Interest on delayed paymentsrefunds: @ ‘The User shall pay interest at the rate of 15% per annum, on the delayed payments of any charge under the Scale of Rates. ww © «xi xi ai (©) Likewise the Port Trust shall pay penal interest a the rate of 15% per annum on delayed refunds, (©) The delay in refunds wll be counted beyond twenty days frm the date ‘of completion of services or on prosuction of all the documents required from the User whichever is ater (@) Delay in payments by usr wil be counted only 10 days after the date ‘of raising the bills by NMPT. This provision will however, not apply to the cases where payment is to be made before availing. the servicevse of port properties as stipulated in the MPT Act, 1963 and/or where payment of charges in advance is prescribed as a ‘condition in the Seale of Rates. The NMPT may, if they so desire, charg lower ates andor allow higher rebates and discounts. ‘The Port may aso, if they so desire rationalise the prescribed cconditionaltios governing the application of rates prescribed in the Scale of Rates if such rationalisation gives relief to the Users in rate per unit and the unit rales preseribed in the Seale of Rates do not ‘exceed the esling level The Ports should notify the public such lower rales and/or rationalisation of the conditonaities governing the aplication of such rates and continue t0 notify the public any further changes in such lower rates andor in the conditionalites governing the application of such rates provided the new rates fixed shall not exeeed the rates notified by the TAMP. Users shall not be required to pay charges for delays beyond a reasonable level “atributable tothe NMPT. @ © ‘The SOR is subject to automatic annua indexation at 100% ofthe WPI to be annually announced bythe Authority. The next annual indexation will be from I April 2017 subject to the NMPT achieving. the Performance Standards notified alongwith the SOR. If Performance Standards prescribed in the SOR are not achieved, there will be 10 indexation in SOR for that particular year, ‘The port should declare the Performance Standards achieved by it annually for the period I January to 31 December vis-a-vis the Performance Standards notified by the Authority atthe level ‘commited by the port within one month of end ofthe calendar year to the concemed users as well as to the Author. I the Performance Standards as notified by the Authority ae achieved by the pont, then the port will automatically index the SOR at 100% of WPI announced by the Authority and apply the indexed SOR wef 1 April of the relevant year. The indexed SOR by the NMPT tobe intimated by the pot tothe concerned users and tothe Authority (xiv) Guidelines on priority berthing of coastal vessels at Major Ports issued by the Ministry of Shipping vide eter No.PT-L103¥S1/2014-PT dated 4 September 2014 (a) “Coastal vessels” is defined as any vesel exclusively employed in trading betwoen any port or place in India to anyother port or place in India having a valid coastal icenseisued by the Ditector General of Shipping / competent authority. (2) In respect of POL / Liquid carpo tankers, existing practices regarding such prioiies as prevalent in various ports may continue. (©) Coastal vessels which are be accorded priority berthing shall not be able to pay priority berthing charges. (0) There will be no restrictions on berthing of coastal vessel in ation to the coastal vessel berthed on priority as above, ifthe same is eligible under normal berthing poliey of te port. (=) A coastal vessel shall be lable to pay port charges on coastal rates notwithstanding whether twas berthed on prioity or otherwise (8) Ports should explore the possibilities of earmarking exclusive ben, Storage areas and gates for coastal cargo outside the custom bonded area ofthe Port oTuther facilitate movement of coastal cargoes, Major Ports shal clatly work ou the time limit within which a coastal vestel would be berthed ina particular port. This Gime limit may differ ‘depending on the cargo and beth. Each Msjor Port should cary out a ‘detailed exereise and issue a trade notice clay indicating the upper time limit within which a coastal vessel would be given a berth in the por. As regants priority berthing through «specific window to coastal Container vessels, Major Ports should have a detailed discussion with the PPP operator and publish the specific window for coastal container vessels. The above mentioned exercise and publication should be ‘completed within 30 days from the date of issue ofthese guidelines. (The MIS in the Por should capture data for coastal and foreign vessels cargoes separately. (i) The hirer shall be lable to pay a penalty of Rs.S00 per every breach ofthe above condition whenever he is found guilty of such breach by the NMPT i) The cost of damage, if any, caused 10 the equipment by its being used in contravention ofthe above condition, shal, in addition to the penalty referred to fabove be recovered from the hirer and shall include even the replacement vile of the equipment if the damage caused makes such a recovery nocessiry 6. The NMPT shall not be responsible to the hirer or any person for any loss or damage or injary to the life of the person arising directly or indirectly from the use of the ‘equipment during the period oft supply fr hire. The hirer shall indemnity the NMPT agains all loss or damage or injury to life arising directly or initectl from the use of ‘the equipment during the period ofthe supply on hire to any property belonging tothe Prt including the equipment, or to any other person or property. The liability ofthe hirer shal not be affected bythe fat that such loss or damage or injury to life may have arisen due 10 any act or default of any employee of the Port. ‘The hirer shall also indemnify the NMPT forall abilities under the Workmen's Compensation Act, 1923, 7. When equipment are requisitioned for a specified number of hours but are made available not continuously but at different times to suit the convenience of the Pot, charges shall he calculated as ifthe hire was fora continuous period hy totaling up the broken periods of work instead of rounding off each spel of work separately '8.
