If personal email that is left behind in the employee’s hard drive etc
or company computer, it is still a grey area as there is no direct
jurisprudence or law or governing the same. Thus, we have to take
the more conservative approach and elude/avoid accessing personal
employee emails. Doing so may lead to possible legal implications,
which we are trying to prevent.
Conclusion.
While the Bill of Rights of the 1987 Philippine Constitution could only
be used against the State, it is still a good corporate practice to make
it known to the rank-and-file that the management has the
prerogative to inspect the digital workstations of their employees.
