AFFIDAVIT OF R. JAVIER GUERRA

Before me, the undersigned notary, on this day personally appeared R. Javier Guerra, the affiant,
whose identity is known to me. After I administered an oath, affiant testified as follows:

I. "My name is R. Javier Guerra. I am over 18 years of age, of sound mind, and capable of
making this affidavit. The facts stated in this affidavit are within my personal knowledge and
are true and correct.

2. "I am an attorney licensed to practice in the State of Texas.

3. "Defendant retained me to represent him in Cause No. 2015-CI-16237. I have personal

knowledge of this case and the work performed.

4. "I have over 20 years of civil litigation experience

5. "It was necessary for Defendant to retain an attorney in this matter.

6. "Based on our fee agreement, Cheraif incurred total attorney fees and expenses in the
amount of $13,855.56 to prepare and file the Petition, prepare and send discovery to Defendant,
prepare and file the Motion for Summary Judgment, attend hearings, research the issues, as
well as review all evidence and confer with clients and opposing counsel. $10,480.56 of the
total billed was paid by Cheraif. Costs of $79.16 for the counterclaim and filing fees were
incurred. The invoices are attached hereto and incorporated herein for all purposes are true and
correct copies of the invoices prepared by me and sent to Cheraif for payment.

7. ''The attorney fees charged in this case were necessary, reasonable, and incurred in the
prosecution of this matter.

8. "Recovery of attorney' s fees and costs is made pursuant to the counterclaim by Ali
Cheraif.

9. "The fees I charged in this case are customarily charged in this area for the same or similar
services for an attorney with my experience, reputation, and ability, considering the type of
controversy, the time limitations imposed, and the results obtained."
