Rodriguez, Jr. 8805 EXPLANATORY NOTE House Bill No. Organized airsoft started in our country in 1985, and interest in the hobby had gone up and down, several times over the past 20 years. The airsoft garring community initially conducted their games in secrecy, but in the recent years has reached the mainstream due to the tremendous surge of newbies, owing to the advent of cheap Crina-made airsoft guns. Airsoft teams ere mostly clan organized, with a number of groups claiming representation, to a certain extent, of the local airsoft communiy, organizing and coordinating between local teams, especially during big events where hundreds of players from tears all over the country converge on Selected venues for triendly tournaments. Letter of Instruction 1264, a Presidential Directive, signed by former President Ferdinand E. Marcos in 1982, bans the import, sale and public display of gun replicas, but purchase of airsoft guns and the movement cf airsoft piayers are largely untouched by the government, with only a few confiscated shiprrents marring that record. No direct regulations have been placed on the airsoft community, and players of all ages and background are welcomed to play. Under this proposal, it shall be unlawful for any person to produce, manufacture, sell Use, ship, transport, give or receive any toy look-alike or imitation firearm unless such item contains, or has affixed to it, a marking approved by the Secretary of the Department of Trade and Industry. Rodriguez, Jr. House Bill No. __ 3805 AN ACT REGULATING THE IMPORTATION, MANUFACTURE, SALE, USE AND TRANSPORT OF AIRSOFT RIFLES/PISTOLS AND FOR OTHER PURPOSES: Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: SECTION 1. Title — This Act shall be known as the Airsoft Immitation Firearm Law of 2013. SECTION 2. Declaration of Policy. Itis hereby declared policy of the State to protect the public from harm due to the unregullated manufacture, sale, use, and transport of any toy look-alike or imitation firearm. SECTION 3. Definition of Airsoft Rifle/Pistol. For purposes of this Act, airsoft rifle/ pistol includes battery operated, spring and gas type powered nfles/ pistols which cischarge plastic pellets only as bullets or ammunition. It difers from replica as the latter does not fire plastic pellet with very low projectile velocity. SECTION 4. Restriction. Airsoft rfief pistol, a special type of air gun, shall be used in sporting activites such as war game simulation only. All airsoft rifles/ pistols shall not exceed 860 feet per second velocity using .20 g'am pastic pellets. An airsoft rifle/ pistol exceeding the said limit shall not be eligible for registration. SECTION 5. Manufacture, Importation and Sale.- All natural and juridical persons who intend to manufacture, import or sell airsoft rifle’ pistol shall apply for a permit to manufacture, import or to sel airsoft rifles! pistols from the Department of Trade and Industry (DT!) and shall be registered with the Philppine Natlonel Police (PNP). SECTION6, Distinctive Marking. - There shal be a distinctive marking for airsoft rf_eypistol as an integral part, a permanently affixed, blaze orange or red pulp in its barrel. Such mark shall be at the tip of the muzzle not less than 6.35 centimeters in length. SECTION 7. Registration for Use. Upon the one-time regstration with the PNP for those airsoft rifles/ pistols with no serial numbers a barcode sticker bearing a permanently assigned unique serial number shall be affixed on @ conspicuous part of the airsoft rile/ pistol. Said barcode sticker shall remain valid for the Ifefime of the gun. Those airsoft rfles/ pistols with existing serial numbers shall be registered using their individually affixed serial numbers. Duplication of serial numbers and/or falsification of barcode stickers shall be deemed as a violation and shall result to the revocation of any airsoft icense issued to the holder. In cases where an airsoft part with the serial number should be repaired'replaced, information ‘of such action shall be submitted to the PNP fo" proper notification. Airsoft riles/pistols must be painted with bright red or orange color on its tip. Any person registering airsoft rifle pistcl must not be below 18 years of age and must be a bonafide member of a duly accredited airsoft club. In case of transfer of ownership to another individual, a copy of the transfer document must be subrvitted fo the PNP for proper recording. SECTION 8. Transport of Airsoft Rifle/Pistol. - A Permit to Transport (PTT) airsoft rfle/ pistol shall be required for the transport of all airsoft rifles/ pistols from the place of residence to any game or exhibition site. The applicaticn for a permit to transport airsoft rifle/ pistol shall be flied with the PNP at their respective regional or provincial police offices. The permit to transport airsoit shall cover a maximum of five (5) airsoft units, whether fifles, pistols or a combination of both. The permit shall be valid nationwide for a period of ‘one year except in areas where there is prevalence of crime and lawlessness While in tarsi, all airsoft rifles/ pistols shall be placed in secured bags or cases and must not be displayed in public. SECTION 9. Airsoft Teams.- Airsoft teams/clubs shall seek accreditation with the PNP. Each airsoft club shall have @ minimum of ten (10) registered owners of airsoft rifle/ pistol, who shall be local residents, and shall abide by the Code of Conduct, Safety, and Rules of Engagement for Games which shall be formulated by a National Airsoft Association for airsoft players and shall be applicable and bincing upon all, during games. SECTION 10. Airsoft Game Sites. - Prior to the use of a particular area as airsoft game site, the operator or duly authorized person In sharge of the proposed airsoft game site shell inform in writing the Chief of Police who has juisdiction over the said area for the conduct of any war game, simulation, shooting competition or exhibition of airsott rifles/ pistols. When located in populated areas, the game site must be enclosed and secure from Public view. No person below 18 years of age shall be allowed inside the game sites. All authorized dealers of airsoff rifle/ pstol shall secure the necessary permits prior for the conduct of airsoft rifle! pistol show or exibition. SECTION 11. implementing Rules and Regulations. The Department of Trade and Industry (DTI), in coordination with the Philippine National Police and other concemed government agencies, shall promulgate the nacessary implementing rules and regulations within ninety. days. after = he. approval «=of,S this. SECTION 12. Penal Provisions. Any person or entity found to have violated the provisions of this Act shall be liable to a fine of not less than One Hundred Thousand Pesos (P'100,000.00) or an imprisonment of not less tran six (6) months, or both at the discretion of the court. SECTION 13. Separability Clause. If any provision of ths Act is declared unconstitutional or invalid, the remainder thereof not affected thereby shall continue in full force and in effect. SECTION 14. Repealing Clause. All laws, ordinances, rues and regulations, other issuances or parts thereof which ere incorsistent with this law are hereby repealed, amended or modified accordingly. SECTION 15, Effectivity - This Act shall take effect fifteen (15) days after its publication in at least two nevispapers of general circulation Approved,
