Sir, It is hereby intimated that the matter was placed before the Hon'ble AP High Court for a decision in the matter wherein it has been decided that the deposit collectors attached to the banks were to be treated as ‘workmen’. It was also intimated that the Hon’ble Supreme Court of India vide its order dated 13.2.2003 affirmed the order of the Hon’ole High Court. It has been reported by the Atl India Deposit Collectors Workmen Union ‘that the deposit collectors attached to the banks have not been extended the PF benefits. It was ‘also directed that necessary action be initiated to extend the benefits to the deposit collectors attached with such banks (Regional Rural Banks, Co-op. Banks etc.) to which provisions of EPF & MP Act, 1952 applies, but as per our records no comprehensive report has been received barring very few regions from whom interim reports have been received (RPFC, Kerala and Mangaiore). In view of the fact that the Hon'ble Labour Minister has desired the matter be examined for necessary action and also sought for a status report, the complete action taken report from the regions is urgently required so that the detailed status of the case could be submitted to the Ministry. You are, therefore, directed to take immediate necessary action on the above lines for extending the benefits of EPF Act and Schemes upon the Pigmy Deposit Collectors attached to banks (RRB & Co-op. Banks), and send an action taken report in the enclosed proforma, Your report indicating the position in respect of all RRBs and Co-op. Banks should reach the Head office by 11.9.2009 positively.
