That the Defendant is charged with Fist Degree Murder and two counts of Assault With Deadly Weapon inflicting Serious Injury and in a bond heating held on October 21, 2019 Judge W. Kobert ell seta 30U,0UU Secured bond, and as a condition of pretrial release ‘ordered electronic monitoring by CMPD in conjunction with 24 hour house arrest. 3. ‘That Charlotte Mecklenburg Police Department changed thelr Electronic Monitoring policy early Friday afternoon, December 6, 2019, and announced that they were not accepting anymore defendants charged with murder on electronic monitoring, 4. That after CMPD changed the EM policy, the Defendant posted bond and was released by the Mecklenburg County Sheriffs Department on the afternoon af December 6, 2039, but was not placed on CMPD EM due to the CMPO policy change. 5. That Judge Lisa ellis currently in the middle of a homicide tial, along with the Defendant's Counsel, that is not expected to end until after December 16, 2019. 6. ‘That the Judge that originally heard this bond hearing, Judge W. Robert Bellis currently unavailable this week BASED ON THE FOREGOING findings of fact the Court CONCLUDES AS A MATTER OF LAW: 1. That the State's Motion should be continued until Judge W. Robert Bell, the Judge that hheard the original bond hearing, and the Defendant's attorney are both available. 2. That although the Defendant cannot be placed on EM, all other bond conditions set by Judge W. Robert Bell continue to apply to include 24 hour house arrest until this motion Is heard, ‘THEREFORE IT IS ORDERED that: 1L. That the State's Motion willbe continued until Judge W. Robert Bell, the Judge that heard the original bond hearing, and the Defendant's attorney are both avaiable. 2. That unti this matter is heard, that all other bond conditions set by Judge W. Robert Bell continue to apply to include 24 hour house arrest. 3. That the Defense Counsel provide the State withthe address thatthe Defendant willbe residing at while under 24 hour house arrest. 4. That the Defendant is permitted to leave the house for medical treatment but the Defendant's Counsel must provide the State with the times thatthe defendant will have to leave the house for medical treatment. 5. That the Defendant is allowed to take High Schoo! classes online while on 24 hour house arrest but must remain at the house 66. That the Defendant is to have no contact with the Co-Defendant in this case, Marcus Joubert 7. That the Defendant isto have no contact with State witness Melvin Davis in this case. 8, That the Defendant is to have no contact with the two living victims in this case, Quaron Lawrence and Mansanka Kanku, 50 ORDERED.
