Comes now, respondent, by counsel, unto this Honorable Office,

respectfully avers the following:

1. On November 27, 2019, the Pre-hearing Conference of the case

was held with Honorable PLTCOL __________________ presiding as
Summary Hearing Officer of the above-captioned case;

2. On the said setting, respondent postulates non-liability to the

offense charged, there being no negligence on his part;

3. On the same setting also, respondent, by counsel, prayed that the

former’s awards, commendations and length of service be credited in his
favor in the appreciation of the penalty, should one be imposed;

4. Now, therefore, in consideration of the foregoing, undersigned

respectfully manifest that respondent’s answer be reconsidered by way of
re-pleading all the averments thereon as the latter’s POSITION PAPER; and

5. The same be submitted in lieu thereof.
