II. Methodology
a. Case Analysis
In order to attain the objective of this study, the authors will use the Case
Analysis methodology in which decided cases will be examined to identify the
pattern and trend of causes of dismissal of employees in the span of twenty years
from 2000 to 2019.
The authors will analyze twenty cases using FILCRO (Facts, Issues, Laws,
Case History, Ruling, Opinion) in order to effectively spot the issues in each case
and determine whether or not there is just cause in the termination of
employment.
b. Interviews
To support the findings in the Case Analysis, the authors will also
interview a Labor Union Leader from the Utilities Sector to provide insight as to
labor cases involving illegal dismissal and to recount their experience with
termination cases.
