ABSOLUTE SALE DEED

THIS DEED OF ABSOLUTE SALE is made and executed at


Bangalore on this17thday ofDecemberTwo Thousand
Nineteen(17/12/2019) BY:-

Aged about 51 years,

Residing at: Masidi Street, 1st Division,
Budigere Village, Channarayapatna Hobli,
Devanahalli Taluk,
Bangalore Rural District - 562129.

Hereinafter called the “VENDOR” of the one part:And

Hereinafter called the “PURCHASER” of the other part.

[The terms “VENDOR AND PURCHASER” shall mean and include


her/his/their respective heirs, representative’s executor’s successor
in interest, agents, administrators, assigns and legal
representatives, wherever the context so permits].

Whereas the above named Vendor is the sole and absolute


owner of the property bearing Residential Site No.23, Comes
Under Property Nos.199/1, Budigere Village Panchayath
Khata No.199/1/23,Situated at: BUDIGERE Village,
Channarayapatna Hobli, Devanahalli Taluk, Bangalore Rural
District.Which is vendor’s Ancestral Property, later the sisters of the
vendor No.2 namely Sri. Chand Pasha have executed release deed in
favour of Sri. Chand Pasha, Vide registered Released deed No. DNH-
4-00195/2011-12, on dated: 28-06-2011, Book-4, Stored in CD
No.DNHD.230, registered in the office of sub- registrar, Devanahalli,
Bangalore Rural District. And he continued position of the property
and subsequently his wife &Children executed release deed in
favour of vendor No.2 Sri. Chand Pasha, Vide registered Release
deed No. 942/2019-20, dated: 30-04-2019, Book-1, Stored in CD
No.DNHD.761, registered in the office of sub- registrar, Devanahalli,
Bangalore Rural District, Since then the Vendor is enjoying the same
without any litigation and free from all kinds of encumbrances.

Her son Sri. Chand Pasha Dated : 13-09-2019, empowering to


get registered the property in favour of intending purchaser.

Whereas the Vendor herein has been paying the taxes in respect of
the schedule property to the jurisdictional revenue authorities and
that the khata of the schedule property has been registered in the
name of the Vendor herein the revenue registers of the jurisdictional
revenue authorities. Whereas the Vendor herein ever since the date
of acquisition of the schedule property is in peaceful possession and
enjoyment of the same as absolute owner without any let or
hindrance from anyone.
And whereas the Vendor being in need of funds to meet his
pressing domestic and other legal necessities has agreed to sell the
schedule property to the Purchaser for a sale consideration of
Rs.16,00,000/- (Rupees Sixteen Lakhs Only)free from all kinds of
encumbrances and the Purchaser has agreed to purchase the same
for the sale consideration of Rs.16,00,000/- (Rupees Sixteen
Lakhs Only).
NOW THIS DEED OF SALE WITNESSE:

That in consideration of the payment of the entire sale consideration


of Rs.16,00,000/- (Rupees Sixteen Lakhs Only)is paid by as
follows :-
a) Rs.12,000,00/- (Rupees Tweleve Lakhs Only)being housing
Loan amount sanctioned by LIC Housing Finance Ltd.,
Bangalore to the purchaser vide their Cheque bearing No.
380035, dated : 11-12-2019, drawn on HDCF Bank, Kasturba
Road Branch, Bangalore, in favour of vendor.
b) Rs.2,00,000/- (Rupees Two Lakhs Only)is paid by Cash on
dated : 30-08-2019.
c) Rs. 2,00,000/- (Rupees Two Lakhs Only))is paid by Cheque
bearing No, 000077, dated : 23-09-2019 Drawn on HDFC
Bank, Mahadevapura Branch, Bangalore, to the vendor before
the whiteness.

The receipt of which the Vendor hereby acknowledge and also
confirm the full and final payment and settlement of the sale price of
the schedule property, the Vendor do hereby grant, sell, convey and
assign to the Purchaser the schedule property together with all the
estate rights, title, interest and easement whatsoever absolutely and
free from all encumbrances.
The Vendor having acknowledged the receipt of the full sale
consideration, the Vendor do hereby convey, sell, transfer and
assign and to the use of the Purchaser the schedule property with all
the right, title and interest in the schedule property of the Vendor up
to the Purchaser for ever as ordinarily conveyed on such sale.
The Vendor hereby covenants and declare that the Vendor possess a
valid right, title and interest to convey the said schedule property
hereby conveyed up to and to the use of the Purchaser in the manner
aforesaid.
Furthermore, the Vendor and all persons claiming under him shall
and will from time to time upon request of the Purchaser do or
execute all such acts, deeds and things whatsoever for further and
more particularly assuring the said schedule property and every part
thereof up to the Purchaser and placing him in possession of the
same according to the intents and meaning of these presents as
shall or as may be reasonably required.

The VENDOR hereby covenant with the Purchaser as follows:-

That the schedule property is Vendor’s absolute, exclusive and


Ancestral Property, and that apart no other persons and their family
members have any Right, Title, Interest or Claim in or over the
schedule property.

That the schedule property and every part of it is free from all
encumbrances, claims, damages, charges, demands and
attachments or acquisition proceedings whatsoever and the Vendor
has good title, and right interest and absolute power and authority to
sell the schedule property and that the Purchaser shall hereafter
peacefully hold, possess and enjoy the schedule property without
any hindrance whatsoever from the VENDOR or any person claiming
under him through in respect of the Schedule Property.

Further the Vendor has not done anything whereby the Schedule
property may be subjected to any court attachment or lien of any
court or person whatsoever and that there are no claim or claims of
any other person or persons whatsoever.

That the Vendor undertake, to save harmless possession and


enjoyment to indemnify and keep indemnified forever the Purchaser
from or against all Action, Suits, Proceedings, Encumbrances,
Charges, Equities, Estate, Claims, Costs, Damages, whatsoever
occasioned or made by the Vendor or any person claiming through or
in trust to him.

That the Vendor at all times hereafter upon any reasonable request
and at their cost do or execute or cause to be done or execute all such
lawful Acts, Deeds or Things whatsoever for further and more
perfectly conveying and ensuring the schedule property and every
part thereof to the Purchaser and place them in unassailable
possession of the same according to the True and Correct meaning
and intent of this Sale Deed.

The Vendor hereby assures the Purchaser that all taxes/cesses have
been paid by the Vendor to the competent authorities in respect of
the schedule property up to the date of registration of this sale deed.
However if any taxes/cesses in respect of the schedule property are
found to be paid subsequently till the date of registration of this sale
deed. The Vendor shall pay the same to the competent authority.

The Vendor assures the Purchaser that the schedule property is free
from all encumbrances and that themselves are none else who have
got any right title interest claims, what so ever and that they have
not done anything either knowingly or unknowingly whereby the title
of the Vendor to the schedule property is impeached.

The Vendor has agreed to indemnify and compensate the Purchaser


against all losses damages that may be caused to be suffered in
future immediately according to the government rate of interest to be
paid on account of any breach of any of covenants content herein on
account of any defect in the title of the Vendor in respect of the
schedule property and protecting the title of the said property in
favour of the Purchaser.

That the Vendor has “NO OBJECTION” for the Purchaser to transfer
the khata of the schedule property in favour of the Purchaser name
at hercost and expenses. The Vendor has this day handed over the
peaceful possession of the schedule property to the Purchaser
together with all the relevant original documents.

The Present Market Value of the Schedule property is


Rs.16,00,000/- (Rupees Sixteen Lakhs Only).

IN WITNESS WHEREOF the VENDOR and PURCHASER have set


their signatures to this Deed of Absolute Sale on the Day, Month and
