REVERSE BIDDING / AUCTION

1.0 INSTRUCTIONS TO BIDDER

i) Price bids submitted by the Bidder shall be opened and shall be evaluated.

ii) After opening of Price Bid, Reverse Auction among qualified Bidders shall
be carried out at the lowest evaluated Bid.

iii) Bidders are required to go through the Guidelines provided for reverse
auction at following e-tendering site: www.eproc.karanataka.gov.in.

2.0 BID OPENING AND EVALUATION

Reverse Auction shall be carried out on the evaluated price.

3.0 TERMS & CONDITIONS OF REVERSE AUCTION

‘REVERSE AUCTION’ among qualified Bidders shall be carried out to arrive at

the lowest evaluated Bid as per following terms and conditions:

1. Technically and commercially eligible bidders only shall participate in the

Reverse Auction. Reverse auction will be conducted on scheduled date &
time, which shall be intimated to all the Eligible Bidders in advance
through e-portal.

2. Reverse Auction shall be carried out through www.eproc.karanataka.gov.in

Karnataka e-portal.

3. Bidders are required to get themselves registered at e-portal of Karnataka

at their own expenses to login in into e-portal Karnataka to participate in
the Reverse Auction process.

4. Bidders shall abide by all ‘Terms & Conditions’ and the ‘Business rules of
Reverse Auction’ specified above. Bidders are required to login into
Karnataka e-portal using Digital signature for participating in the Reverse
Auction event for which they have been invited. Logging into e-portal by
Bidder to participate in the Reverse Auction event shall be considered as
Bidder’s unconditional acceptance of all ‘Terms & Conditions’ and the
‘Business rules of Reverse Auction’ specified above and/or e-portal.

5. If the Bidder or Associate/Collaborator of Bidder or any of their

representative(s) are found to be involved in Price manipulation/ cartel
formation of any kind, directly or indirectly by communicating or through
any other means with other Bidder(s) or their Associate/Collaborator,
action as per extant Owner guidelines/policies, shall be initiated by the
Owner.

6. The Bidder shall not divulge either his Bids or any other exclusive details
of the Owner to any other party.

7. Period of validity of Prices received through Reverse Auction shall be same

as that of the period of validity of bids offered.

8. Bidders may also note the following:

• Although extension time is ‘8’ minutes, there is a time lag between the
actual placing of the bid on the local computer of the bidder and the
refreshing of the data on to the server for the visibility to the Owner.
Considering the processing time for data exchange and the possible
network congestion, Bidders must avoid the last minute hoisting of the
Price Bid.
• Participating Bidders agree to non-disclosure of trade information
regarding the purchase, identity of Owner, Bid Process, Bid
Technology, Bid Documentation and Bid details.

9. Bid event will lead to the final price only.

10. Order shall be placed outside the e-portal & further processing of the
award shall also be outside the system.

11. In case of any problems faced by the Bidder during Reverse Auction on
Karnataka e-portal and for all Reverse Auction related queries regarding
Karnataka e-portal, Bidders are advised to contact HELP DESK at 080-
25501216 / 25501227 of e-tender portal.

12. Eligible Bidders are advised to visit the auction page and enter the ‘live
auction’ well in advance to avoid last minute hitches.

13. Software/hardware related issues, telephone line glitches and breakdown /

slow speed in internet connection of PC at Bidder’s end.

14. It may not be possible to extend any help, during Reverse Auction, over
phone or in person in relation to rectification of PC / Internet / Java
related issues and Owner will not be responsible in case Bidder loses the
chance of participation in the auction for reasons attributable to the
Bidder or beyond control of Owner.

15. No queries shall be entertained while Reverse Auction is in progress.

16. In case user ID is locked, Bidders are requested to call e-portal helpdesk.

4.0 BUSINESS RULES OF REVERSE AUCTION

1. Short listing of Bidders:

After completion of evaluation of Techno-Commercial bids, Price bid

Ranking of all the qualified bidders shall be done based on their
evaluated Price. The short listed eligible Bidders for Reverse Auction shall
be invited for the Reverse Auction through Karnataka e-portal/email,
before the start of Reverse Auction.

2. Schedule for Reverse Auction:

Date and time of start of Reverse Auction shall be intimated to all the
eligible Bidders prior to Reverse Auction. Initial duration of Reverse
Auction shall be one hour.

3. Auction extension time:

If a valid bid is placed within 8 minutes of End Time of the Reverse

Auction, then Reverse Auction duration shall get automatically extended
for another 8 minutes from the existing end time. It may be noted that
the auto-extension will take place only if a valid bid comes in those last 8
minutes. If a bid does not get accepted as the lowest bid, the auto-
extension will not take place even if that bid might have come in the last
8 minutes. The above process will continue till no bid is received in last 8
minutes which shall mark the completion of Reverse Auction. However,
bidders are advised not to wait till the last moment to enter their bid to
avoid complications related to internet connectivity, their network
problems, system crash down, power failure etc.

4. Bid price:

The Reverse Auction will be carried out on the ‘evaluated Price’.

Bidders will be able to see, on their screen, the breakup of their
evaluated price (Quoted Price in INR, Taxes & duties and differential
loading on account of guaranteed parameters). Bidder has to
quote/change/reduce the Quoted Price (in equivalent INR) so as to
beat the starting price/current L1 price (evaluated Price) displayed on
the screen to become L1 Bidder.

5. Procedure of Reverse Auctioning

i. The Owner will evaluate/calculate the evaluated Price of each of the

Bidder who have submitted their Price Bid including Price Schedule.

ii. Online Reverse Auction: The ‘Opening Price’ i.e. Start Price for
Reverse Auction) shall as be decided by Owner.

iii. The minimum Bid Decrement shall be Rs.50,00,000 (INR Fifty Lakh
only)/-. As such, the Bidders are required to necessarily reduce
their evaluated Price by minimum one decrement (i.e. Rs.50,00,000)
to beat the starting price/current L1 price (evaluated Price)
displayed on the screen to become L1 Bidder. However, Bidders are
free to decrease their prices by any value more than Rs.50,00,000/-.

iv. The above process at sl.no. (iii) above will continue as an iterative
process till end of Reverse Auction.

v. After completion of the online Reverse Auction, the Closing Price

shall be available for further processing.

6. Post Reverse Auction Procedure:

KPCL will proceed with the Lowest Bid received in the Reverse Auction for
further processing and award considerations.

If no bid is received in the auction system/ website within the specified

time duration of the online RA, then Owner will scrap the online Reverse
Auction process and proceed with the Bid Prices received through e-
tendering for further processing.

7. During the RA, if a bidder is not able to bid and requests for extension of
time by e-mail/fax, then time extension of additional 15 minutes may be
given by Owner provided such requests come at least 8 minutes before
auction end time and no bid is received by Owner till that time.

However, in order to ward-off such contingent situation, Bidders are

requested to make all the necessary arrangements/ alternatives whatever
required so that they are able to circumvent such situation and still be
able to participate in the Reverse Auction successfully. Failure of power or
loss of connectivity at the premises of bidders during the Reverse Auction
cannot be the cause for not participating in the Reverse Auction. Owner
shall not be responsible for such eventualities.

8. After completion of the Reverse Auction event, based on the final price
quoted by the Bidders, successful Bidder shall submit Break-up of Final
Price to Owner on the same day.
It may be noted that while preparing Break-up of Final Price, L1 Bidder
shall apply uniform % discount over the original items rate quoted in
various Price Schedules, as the case may be. In this regard, it is to inform
that Owner will inform the uniform % discount to be applied to various
Price Schedules to the L1 Bidder. After incorporating the aforesaid
discount percentage in Schedule (currency wise), the L1 bidder shall
submit final Price Schedules duly signed by Authorised Signatory to the
Owner through e-portal/email.
Bidders to note that the final Price as per currency wise breakup shall not
exceed the final Price of the Package received after completion of Reverse
Auction.

9. Any variation between the Total Price after Reverse Auction and that in the
Break-up of Final Price, sent through registered e-mail will be considered
as tampering the tender process and will invite action by OWNER as per
extant guidelines in vogue.

10. Owner decision on award of contract shall be final and binding on all the
Bidders.

11. Owner reserves the right to cancel/reschedule/extend the Reverse Auction

process/ tender at any time, before ordering, without assigning any
reason.

12. Owner shall not have any liability to bidders for any interruption or delay
in access to the site irrespective of the cause. In such cases, the decision of
Owner shall be binding on the bidders.

Other terms and conditions shall be as per Bidder’s techno-commercial offers

and as per Owner’s bidding documents and other correspondences, if any, till
date.
