THIS DEED OF MORTGAGE made at Rawalpindl on this ___ day of 2019 BETWEEN
Mst. Talat Zabla W/o Firdaus Mumtaz Abbasl, CNIC No.61101-3201926-2, Resident of 1&7
Centre, House No.29, St.1, G-9/1, Islamabad permanently resident of PO Khas, Rawat,
Tehsil Murree, District Rawalpindi, [hereinafter called “The Mortgagor “) which term
shall, wherever the Context so requires include its successors in interest, representatives
‘and assigns.
AND
M/S ASKARI BANK LIMITED, a company incorporated under the Companies Ordinance
1984 having its Head Office at AWT Plaza, The Mall, Rawalpindi and a branch office at
Adiyala Road Branch, Rawalpindi (hereinafter called “The Bank") of the other part:
WHEREAS the mortgagor is seized and possessed of and otherwise lawfully entitled in his
name that piece and parcel House No.SN-87-B, measuring 04-1/2 Marla, situated
in Dhok Kala Khan, within limits of Town Municipal Administration, Rawal Town,
Rawalpindi having ocquied the same vide Sale Deed No.5799, Book No.1, Vol.
“No.283, Pages 122, Addilional Book No.1, Vol. No.2792, Pages 414-419, dated
28.09.2013 registered at the Office of Sub Registrar, Rawalpindl.
WHEREAS at the request of the Mortgagor, the Bank has agreed to provide financial
foclities to M/s Tashfeen Abbas! & Brothers, sole proprietorship concem of Mr. Tashfeen
Firdaus Abbas!, s/o Firdaus Mumtaz Abbas}, CNIC No.61101-1906819-1, having its place
Of business at Office No.8, Rajgan Plaza, KRL Road, Rawalpindi hereinafter referred to os
SThe Customers") in terms of agreement, executed or to be executed time and again
on the renewal of faclities, on the basis of amongst other securities and against
Mortgage of the said property.
NOW THIS DEED OF MORTGAGE WITNESSETH:
1. In consideration aforesaid the Mortgagor doth hereby Mortgage the said
property unto the Bank fo hold the same unfil the payment / repayment of all
Tnoneys due under the sald agreement or any renewals or replacement thereot
for a token amount of Rs:100,000/- (Rupees One Lac only) with service charges
or any payable and any sum due ee accordance with the agreed

tems and conditions of repayment os oforesoid. The remaining amount of
Hiokce Focitty is secured through the creation of an Equitable Morlgage.
2, That the Mortgagor shall pay/ensure payment of all sums due and poyable to
the Bank in accordance with the agreed terms and conditions.
3, Thal [he said property is free from ail cicims, liens, encumbrances ond charges of
Tielneever nature and the Morigagor shall not in any way allow or permit

property free from all charges and encumbrances of whalsoever.
4, Thal the Mortgagot during the continuance of the Mortgage. shall keep the scid
MMoperty adequately insured with an insurance Company approved by the Bank

the premie os ond when due to ond shall pass on all receipts therefore, to the
Bone Incase the Mortgagor fail or omit fo pay any such premia the Bank may
pay ihe same on behalf of the Morlgagor/Customer the amount so spent plus
En’ addition of 20% thereof as liquidated damages all of which shall stand
secured herein
5. That in defoult of payment of any installment by the Customer/Mortgagor, the
Bank notwithstanding any thing contained herein, shail be entitled to serve 30
days nolice upon he Meslaagor calling upon him to pay the entire amount then
ue.
&. That the Bank after giving the notice in writing to the Morigagor, shall have the
fight to sell the sold property or any part thereof ellher by public auction or by
private treaty, without the intervention of court including the right to purchase
the said properly or any part thereof for ilself at such sale on the happening of
‘any of the following events:

8. That the mortgagor shall allow the bank or its authorized agents at all reasonable
times to enter upon the said property or any part thereof had to view and
examine the condition thereof.
%. This mortgage shall be a continuing security and shall not be considered as
either wholly or partially satisfied or redeemed by mortgagor or the customer
and shall be security for any amount ullimately due to the bank from the
mortgagor or the customer on any account whatsoever.
10. That the bank may as it may deemed fit without reference or notice to the
mortgagor and without obtaining his consent at all times without prejudice to this
mortgage and discharging or in any way effecting the mortgagor's liability
hereunder gront time or other indulgence to or accept or make any
composition or arrangement with the customer and also vary / renew /extend
the said agreement from time to time.
11, Any notice to the mortgagor on the address given to the bank or as in the title of
these presents, shall be deemed to be sufficient and valid for all purposes and
shall be deemed to have been served if sent by post or left at the address.
12.On payment of all dues to the bank, the bank shall at the cost of mortgagor
redeem the said properly free of all obligations arising under this deed.
13, That the terms "Morlgagor", "Customer" and the "Bank" wherever the context
so permanents shall always mean and include thelr respective successors -in -
Interest and assigns,
14. That the Mortgagor and/ or customer shall pay all commission, fee, charges etc.
on the facilities chargeable by Ihe Bank In he course of its normal business.
15. Thot any facility allowed by the Bank shall be adjustable in accordance with the
schedule of repayment in the relevant sanction advice as amended from time
fo time and / or practice of the Bank or at the demand of the Bank.
16, That the Mortgagor and / or customer shall pay mark-up al the rale provided by
the relevant sanction advice on facility or at my higher rate for which Bank may
be entitle to charge.17. That notwithstanding anything contained herein above, the charge of the Bank
on the mortgaged properly shall not extinguish by the payment /adjustment of
the Present facllity but the mortgaged property shall remain charge with the
Bank fill the satisfaction of all its claims against the Mortgagor and / or Customer
on account of any facility allowed to them and / or them renewed by the Bank
in its normal course of business.
18. That al terms and conditions as amended time to time, contained in relevant
sanction advice also constitute terms and conditions under this deed.
19, That the Mortgagor will be the guarantor of the customer.
SCHEDULE OF MORTGAGED PROPERTY:
All that piece and parcel of piece and parcel of House No.SN-87-B, measuring 04-
1/2 Marla, situated in Dhok Kala Khan, within limits of Town Municipal
Administration, Rawal Town, Rawalpindl having acquired the same vide Sale Deed
No.5799, Book No.1, Vol. No.283, Pages 122, Additional Book No.1, Vol. No.2792, Pages
414-419, dated 28.09.2013 registered at the Office of Sub Reglstrar, Rawalpindl. The term
“Property” with reference fo the above mentioned plot shall include alll rights corporeal
therein and all present and future structures, buildings, constructions, fixtures, already
raised of to be raised in future thereon and all easement, amenities etc.
