ROCKFORD gr S Nicholas 0. Meyer Legal Director Department of Law January 3, 2020 Sabrina Noah Cresco Labs 2696 McFarland Rd. Roekford, IL 61114 Re: Sunnyside cannabis dispensary; nuisance business Dear Ms. Noah: The City of Rockford has been contacted by several neighboring property owners that have been negatively impacted by the business operation of Sunnyside Dispensary. Your patrons have been observed urinating on neighboring property; smoking cannabis immediately after leaving your location; and parking in unauthorized lots of neighboring businesses for such lengths of time that are detrimental to those business and are preventing their customers from parking and patronizing their stores and offices. Section 19-3 and 19-4 of the City of Rockford Code of Ordinances prohibits anyone owning or occupying a building or premises from using or permitting the use of said business if such use shall disturb or destroy the peace of the neighborhood in which such building or premises are situated, or be dangerous or detrimental to health, Further, Section 17-3 and 65 ILCS 5/11-60-2 authorize the City to prevent and abate public nuisances. If Sunnyside does not take affirmative steps to mitigate the detrimental impact to surrounding businesses, including parking, security, illegal consumption, and other unlawful activity, the City will pursue all legal and equitable remedies to preserve the public peace and abate the public nuisance created by your business. At a minimum, until further notice Sunnyside must cooperate with the Rockford Police Department to immediately address these issues, including hiring adequate security and traffic control personnel to allow neighboring business to re-establish and maintain normal operations.
