AGENDA NOTE SUBMITTED TO THE TECHNICAL COMMITTEE OF

CHIEF ENGINEERS, GHMC FOR APPROVAL OF EXTENSION OF TIME


Sub: Engg.- PD-WZ-I- Remodelling and Improvement of Storm water drain from
Hafeezpet Cheruvu to Patel Cheruvu –Certain balance works - Extension of
Time upto 31-03-2020 - Proposals submitted –Approval - Req.-Reg.
1. It is to submit that Government vide G.O. Rt.No.415, Dt: 20.07.2017 accorded
administrative sanction for an amount of Rs.230.00 Crores for the Improvement of Bottleneck
stretches of Storm Water Drain and the work of Remodelling and Improvement of Storm water
drain from Hafeezpet Cheruvu to Patel Cheruvu in Circle 21, GHMC is one among the 47 works
sanctioned vide GO mentioned above. The work of Remodelling and Improvement of Storm
water drain from Hafeezpet Cheruvu to Patel Cheruvu in Circle 21, GHMC is sanctioned for
Rs.8.00 crores and allotted to M/s. R.K.Infra Corp Pvt. Ltd on tender basis @ (-)2.48 % less
than estimated contract value Rs 6,94,68,710/- with tender contract value of Rs. 6,77,45,885.99/.
Accordingly the agreement was concluded vide Agmt no: 35/SE(P-WZ)/GHMC/2017-18
dt:13.03.2018 mark out was given to the agency on 13.03.2018.

2. In this regard it is to submit that as per the estimate box drain of size 2.0 X 1.5m
is proposed for a length of 1100m from Hafeezpet Cheruvu to Culvert on NH65 at Alwyn X
Roads, which passes through Janapriya Nagar Main Road and BR Hemadurga Apartment Court
Yard Portion.

3. Accordingly, work started at two reaches in Janapriya nagar and by July 2018
235m length completed and further work was kept on hold due to monsoon season. Meanwhile
nala widening inside BR Hemadurga apartments was objected by Apartment Residents on 25-12-
2017, and they have approached Hon’ble High Court on 26-12-2017 vide WP No 44337/2017.
Further, while taking up work on downstream side of BR Hemadurga apartments in road portion
of 100m length on 05-04-2018, once again the Apartment Association stopped the work stating
that it is a private road to Hemadurga Apartments. Due to pending court case and stiff resistance
from Residents of BR Hemadurga, the Clear stretch available is 450m only, out of sanctioned
length of 1100m and finally 255m RCC box is completed out of 450m clear length available.

4. Meanwhile, the contractor vide letter Lr No RK-GHMC/PWZ/22419 Dt:- 22-04-19


made request to close the contract duly stating the following reasons:-

i. Service lines such as water, electricity, communication cables, were passing in the
alignment of proposed nala, due to which extra care is taken while excavation and
restoration of accidentally damaged service lines consumed lot of time.
ii. BR Hemadurga stretch not handed over to take up work.
iii. BT Dismantling work taken up from BR Hemadurga Entrance gate upto NH65 and due to
stiff resistance from residents claiming it as private road, the work was kept on hold.

5. Further as this total work is being taken up on road portion the work was carried
out in 30m stretches consumed lot of time as RCC box construction sequence takes more time. In
view of slow progress of work and inconvenience the local people raised the issue several times.
Finally during discussion it was informed to the local residents that the contractor requested to
close the contract and accordingly the local people requested to terminate work to the extent of
work taken up and requested to resume the work after monsoon.

6. Meanwhile Zonal Commissioner, Serilingampally zone, GHMC enquired about


the completion of balance length 195m upto BR Hemadurga Towers, with Superintending
Engineer(PWZ), GHMC and suggested to transfer the above said work to EE- Circle 21, GHMC
for taking further necessary action.

7. Further during a review meeting on 01.10.2019 by The Commissioner, GHMC


along with Hon’ble MLA Serilingampally, CE(P), Zonal Commissioner Serilingampally with
regard to balance nala works in Chandanagar division, it was explained to The Commissioner,
GHMC about the LA issues and The Commissioner, GHMC instructed CE(P) to take up the
balance nala works wherever clear stretches are available and also instructed to take up balance
works through the same contractor M/s. R.K.Infra Corp Pvt. Ltd. Further The Commissioner,
GHMC instructed to prepare fresh estimates after LA process is completed for balance length of
bottle neck stretches.

5. Further it is to submit that, during meeting on 10.10.2019 with Hon’ble MLA


Serilingampally, Zonal Commissioner Serilingampally and SE(P-WZ), CP West Zone it was
discussed about the LA issues and the balance works to be completed to make the nala works to
logic end in view of safety which were held up due to monsoon.

6. In view of above, the contractor has been requested to take up construction of 2m


box from Kaithamma kunta surplus to recently constructed 2m RCC box i.e., for a length of
195m.

7. Further the contractors vide their Lr.no: . RK-GHMC/PWZ/SE/ P-M/EOT1/1319


dt:________ requested for extension of EOT period upto 31-03-2020 stating the following
reasons:

 A decision was taken by The Commissioner GHMC vide during review meeting dated
01-Oct-2019, in which he instructed to complete the balance works with existing
contractor, therefore, in order to mobilize men and machinery and complete the balance
length of 195m EOT is requested upto 31-03-2020.

8. In view of the reasons mentioned above, it is requested to grant extension of time


upto 31.03.2020 so as to complete Misc. works without any financial implication (except price
variation/adjustment as applicable) to GHMC.

9. In the matter related to granting EOTs , the Commissioner, GHMC has directed to
put the proposals before the Technical Committee comprising of three Chief Engineers and in
pursuant of note orders of Commissioner, GHMC, the Chief Engineer (P) has issued proceedings
to this effect vide proc no: GHMC/CE(P)/2018-19 dt:22.10.2018 according to which the
Extension Of Agreement Time (EOAT) proposals for all non-EPC project works and EPC
project works (up to first six months period) shall be examined and finalized by the Technical
Committee of three Chief Engineers.

10. Therefore, the Committee of Chief Engineers, GHMC is requested to grant


Extension of Time up to 31-03-2020 without any financial implication (except price
variation/adjustment as applicable) for the work of “Remodelling and Improvement of Storm
water drain from Hafeezpet Cheruvu to Patel Cheruvu” for completing the balance work as
requested by the contractor.
