DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY

WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, ROGELIO M. PAGUIO, died intestate at Jose R. Reyes Memorial


Medical Center Manila on January 4, 2015, leaving no will nor debts settled to date
but leaving a parcel of land;

WHEREAS, at the time of his death, he left as forced heirs, the following and to
wit:

FREDERICK C. PAGUIO, of legal age, Filipino, married, and with


residence and postal address at 18 Ilaya St., Alabang, Muntinlupa City.

FROILAN C. PAGUIO, of legal age, Filipino, married, and with residence


and postal address at 18 Ilaya St., Alabang, Muntinlupa City.

FLOYD C. PAGUIO, of legal age, Filipino, married, and with residence


and postal address at 18 Ilaya St., Alabang, Muntinlupa City.

NARLIE C. PAGUIO, of legal age, Filipino, widow, and with residence


and postal address at 18 Ilaya St., Alabang, Muntinlupa City.

WITNESSETH:

THAT we are the legitimate children and spouse, respectively, of ROGELIO M.


PAGUIO, who died on January 4, 2015 in Manila City; copy of his death certificate is
hereto attached as Annex “A”;

THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;

THAT said deceased, at the time of his death, left a certain real property,
situated in Antipolo City and more particularly described as follows, to wit:

TECHNICAL DESCRIPTION

A parcel of land ( Lot 716-B-1-C of the subdn. Plan, Psd-056676,


being a portion of Lot 716-B1. (LRC) Psd-170464, LRC Rec. No.
6137), situated in Brgy. of Alabang, Muntinlupa Metro Mla., Island
of Luzon. Bounded on the W., along line 1-2 by lot 716-B-2; on
the N., Along line 2-3 by Lot 716-B-3, both of (LRC) Psd-170464;
on the E., along line 5-4-5 by Lot 716-B1-B of the subd. Plan; and
on the S., along line 5-1 by Lot 716-A, (LRC) Psd-83040, Beginning
at a pt. marked “1” on plan, being S. 67 deg. 24’E., 600.55 m. from
Mon. No.12, Muntinlupa Estate; thence N. 00 deg. 19’E., 8.21 m.
to pt., 2; 88 deg 35’E., 3.30 m. to pt. 3; S.00 deg. 17’w., 1.00 m. to
pt. 4; S. 00 deg. 17’w., 7.32 m. to pt. 5; N. 86 deg.37’w., 3.30 m. to

pt. of beginning; containing an area of TWENTY SEVEN SQ. M.
AND FIFTY SQ. DECIM. (27.50) more or less.

WHEREAS, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate over the
same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court of
the Philippines, subject to the liabilities imposed by Section 4, of the same rule.

WAIVER OF RIGHTS

WHEREAS, We, FREDERICK C. PAGUIO, FLOYD C. PAGUIO AND FROILAN C.


PAGUIO (whose personal circumstances is mentioned above) has agreed and
covenanted to CEDE, TRANSFER and CONVEY unto our co-heir NARLIE C. PAGUIO
(whose personal circumstances are mentioned above), their heirs and assigns the full
ownership and possession of the above-described property.

NOW, THEREFORE, for and in consideration of the foregoing premises, We


waived and renounced as by these presents, We hereby WAIVE and RENOUNCE our
share, right and participation over the above-described property in favor of NARLIE
C. PAGUIO their heirs and assigns the full ownership and possession of the above-
described property.

IN WITNESS WHEREOF, we have hereunto set our hands, this _____ day of
