Arese, a south Asian Country is a union of 29 states, which is constituted by a written
Constitution. The Constitution of Arese makes the provision of health care and the responsibility of the state government. This brings in the legislation of many environmental laws, which also include BMW (Biomedical Waste) handling with its nature. Mr. Satyajeet Ghosh, who was admitted to the Medfoil hospital, for his kidney failure in September 2015, later affected by Tuberculosis, which prolonged his stay in the hospital for one and a half months. During his stay, he observed the improper disposal of biomedical waste by the Medfoil Hospital. After his research, he finds negligent regulation of the State of Morgalia. Further, he with his research finds the import of BMW, taking place on three states within the territory of Arese, for which, he files an application in NGT (National Green Tribunal) in the year 2018. The averments made in the application includes the central government for its negligence of regulation of import and export in the country, the state government for its negligence and Medfoil Hospital for its careless handling of BMW. NGT passes an award favoring the original Applicant (Respondent) and ordered 1 Crore fine for each original respondents (Petitioner’s) for non-compliance of law, which aggrieved the respondents in filling, a Special Leave Petition before the Hon'ble Supreme Court of Arese. As the result of award passed by NGT, Hospital Association of Arese also joins with the Respondents as an Intervener in the Appeal to The Supreme Court of Arese.
