MA-336/2018 & MA-337/2018 – These Two Applications are from the side of
the R.P. seeking an injunction that during the period of Moratorium the License
by the DOT i.e. Telecom Licenses need not be terminated/suspended and the
Respondent be directed not to take any action.
3. The Applicant apprehends that the Respondent/Union of India may
terminate/suspend the Telecom Licenses. Therefore, it is prayed in this
Application that Union of India be directed not take any action against the
Petitioner in relation to any unpaid dues.
4. On hearing the Learned Counsel for the Petitioner and the Learned Counsel

the side of the Government it is informed that since the Resolution Plan stood
approved by the Committee of Creditors and the Application has been moved
to take action under section 31 of the Code, therefore, it is necessary to see
and examine whether the Resolution Applicant has made a provision for
payment of License Fees to the Applicant with regard to the unpaid dues.
5. It is hereby directed to the R.P. to specify the relevant portion of the
Resolution Plan and meanwhile file an Additional Affidavit by way of Rejoinder
along with evidence to be annexed in it about the position of the availability of
the funds . To be filed by 19.06.2019.
