Sir,

1. Under and subject to the Conditions of Tendering annexed hereto, the undersigned does
hereby tender and offer to execute and perform the works and provisions and supply all labour
and materials and everything of every kind respectively named, shown, described and alluded
to in, or to be inferred from the Tender Documents and Drawings, to be executed and supplied
to the part of the Contract, for the works above described in conformity with the said Tender
Documents and Drawings and under and subject to the said Conditions of Contract for the form
price named herein below.

2. The undersigned agrees to be bound by and submit to the said Conditions of Contract and
priced Bills of Quantity and agrees that the priced Contract Documents, after rectification of any
errors and agreed by the Landscape Architect, as by the Conditions of Contract provided shall
form the basis for the valuation of interim certificate and any variation or extra work which may
from time to time be ordered by the Landscape Architect.

3. And further, the undersigned agrees to complete the Works within five (5) calendar months for
Alternative Tender “A” and within (10 months) all from the Date of Possession of Site or within
any extended period as provided for in the Conditions of Contract.

4. And further, the undersigned agrees that until a formal agreement is prepared and executed,
this tender, or tender adjusted by agreement together with your written acceptance shall
constitute a legal and binding contract between us.

5. The undersigned confirms, after personal scrutiny, that the Tender Documents and Drawings
used by the undersigned in compiling this tender are true copies of the said Tender Documents
and Drawings included in the Tender Table Documents.

6. The undersigned is deemed to be authorised personnel to sign on behalf if the company.

COMPLETION OF THE WORK

1.0 Cleaning up Site

1.1 The Contractor shall trim grass, clear and remove from the site and
at adjacent site (if any ) and dispose off at his own dump all rubbish,
waste and superfluous materials arising from the works and leave the
site in a clean state acceptable to the S.O.

2.0 As Built Survey and As Built Drawings

2.1 The Contractor shall engage a Licensed Surveyor to carry out as-
built survey to record the actual construction details of the Works and
the Licensed Surveyor shall prepare and endorse the as-built drawings.

2.2 On completion of the whole works under this contract, the


contractor shall submit the final sets of As-built drawings required
comprising in two (2) sets, one (1) set blue print with tracing and one
(1) sets in CD of As Built/ Completed Drawings to the S.O. within 30
days after the issuance of the Certificate of Practical Completion
(C.P.C).

3.0 LOCAL AND OTHER AUTHORITIES NOTICES AND FEES

1.0 The Contractor shall be full responsible for compliance with the
local and other Authorities acts, JKR, TNB, JBA, JPP, etc., notices
apply for all necessary permits, licenses etc., pay all fee required,
display permits, licenses etc., renew if expired throughout the contract
period. He shall pay and indemnify Majlis Perbandaran Nilai against
any charges demandable by law thereunder in respect of the Works.

2.0 Allow provisional sum for payment of contribution to Local


Authorities, JKR, TNB, JBA, JPP, etc.

GENERALLY

1.0 Preliminary Items

1.1 The Preliminary items as set out here under are deemed to
appley to the whole of the works all as shown on the
drawings and/or described in this Document and the
Contractor shall allow for complying with same and for any
cost in connection there with

1.2 Each item/ clause shall be individually priced in INK

1.3 Where any items/Clauses is left unpriced, it shall be


deemed that the cost of such items/clauses have been
allowed for elsewhere within the tender and no subsequent
claims arising such unpriced items/clauses shall be
entertained.

2.0 Definitions

2.1 “Government” shall mean ‘Majlis Perbandaran Nilai” unless


the context means the government of Malaysia, or any State
Government in Malaysia, or unless the context otherwise
requires. The abbreviation MPN used extensively in the
Documents shall be taken to mean Majlis Perbandaran Nilai

2.2 “Client” – shall mean “Majlis Perbandaran Nilai”

2.3 “Superintending Officer(s.o)” – shall mean “Yang Dipertua


Majlis Perbandaran Nilai”

3.0 Avoidance of Nuisance

3.1 The contractor shall note that his workers must only be
confined within the site given and shall not cause any
inconvenience to the operation of adjoining works during the
currency of this contract which may be done by different
Contractors. The Contractor shall also allow the Client’s
worker to install any plant, etc during the currency of the
contract and no claim shall be entertained for any
inconveniences arising there from.

4.0 Law, Regulation And Requirements

4.1 The Contractor shall comply to Part VIII of the Lembaga


Pembangunan Industri Pembinaan Malaysia Act 1994 and
the Construction Industry (Levy Collection) regulations
1996, and shall submit a notification on from CIDB L1/96 to
the Lembaga not later than 14 days after the issuance of the
Letter if Acceptance / Letter of Award / or any document that
constitutes acceptance of a contract of works, or not less
than 14 days before the commencement of the works,
whichnever date is earlier.

4.2 The Contractor is responsible to pay the Levy imposed By


LPIPM. The Contractor shall be entitled under this item only
when he produces the proof of levy payment issued by the
CIDB

FORM OF CONTRACT

The Form of Contract to be used shall be the Standard Form of Contract


Where Quantities From Part Of The Contract PWD 203A – Rev 2007 with
amendments.

This is firm price contract except for prices of cement, steel, aggregates,
sand, bricks, timber, glass, ceiling materials, roofing materials, steel and
metal sections, plumbing materials, floor and wall tiles, sanitary fittings,
ironmongery and paint here in after specified.

For due observance and performance of this contract the contractor


shall option for either.

(a) Performance Bond in the form an approved Bank and Insurance


Guarantee equal to Five percent (5%) of the contract sum to be
deposited with the Government as a precedent to the
commencement of any work under this contract.

(b) Performance Bond in the form of performance Guarantee Sum
where the contractor shall allow deductions of ten percent (10%)
from interim Payments until the total amount deducted
aggregate to sum equivalent to five percent (5%) of the original
contract sum.

(i) Not with standing anything to the countrary contained else
where in the contract documents, the contractor shall cause all
sub- contractors whether nominated or otherwise to comply

S.O whether demanded or not, the Employer’s Code Number

(a) The contractor shall maintain and furnish to the S.O a full list of
all his workmen including all workmen employed by sub-
contractors and nominated sub-contractors employed in or in
connection with the Works.

(b) A further copy of the particulars of workmen above shall be


maintained and kept at Works site at all times for inspection.

(a) If in opinion of the Contractor the proper execution of works


involves a variation not arising form an S.O’s instruction, the

(i) Not with standing any provision in this Contract it is hereby


agreed that :-

(a) The Bills of Quantities have been measured generally


in accordance with the general principles of the
“Standard Method of Measurement of Buildings
Works” as published by the Institution of Surveyors
(Malaysia) for use in Malaysia.

(b) The Government may depart from the said Standard


Method of Measurement is likely to be more clearly
understood by the Contractor or where a composite
description is more suitable in the circumstances.

(c) Where depatures have been made from the said


Standard Method, the method used in the preparation
of the Bills of Quantities shall be adhered to for the
purpose of ascertaining the value of the work

(d) The Contractor shall NOT use the information in these


Bills of Quantities for the ordering of materials. All
information necessary for the ordering of materials
shall be ascertained from the Contract Drawings by
the Contractor.

(i) (a) Materials and workmanship are to be the best of their


respective kinds and by “best” shall be understood that no
superior class specified materials or workmanship is
available in Malaysia.

(ii) (b) The Materials of Malaysian Origin and / or locally


manufactured materials shall be used by the Contractor to
the exclusion of imported materials and he shall allow for
this special requirement in his tender.

(i) (c) The locally manufactured materials are listed in the ‘Senarai
Bahan – bahan Binaan Tempatan’ , issued by Kumpulan
IKRAM Sdn. Bhd for civil engineering materials or approved by
Kementerian Belia Dan Sukan for other materials before they
can be accepted for use in the Works by the S.O. Testing and
certification by other testing body may be allowed with the
S.O’s approval.

(ii) (d) If the Contractor fails to comply with this requirement, the
materials supplied shall be rejected and displinary action shall
be imposed upon the Contractor.

(iii) (a) Materials and workmanship shall comply with the British
Standard wherever applicable and shall be approved by the
S.O. The Edition current at the date of closing of the tender is
implied in each case. The Contractor shall not alter or amend
any of the descprition of materials in the Bills of Quantities and
except where expressly provided to the contrary, any offers of
alternative material still render the tender laibvle to
disqualification. Where in the Bills of Quantities any goods or
materials specifies, such are to be considered as being the
minimum standard acceptable. In the event of the S.O. allowing
the substitution of any of the materials during the course of the
Contract, such substitution shall be accompanied by a
corresponding deduction in cost unless the S.O Otherwise
directs.

(iv) (b) The Contractor shall at his own cost and expense, submit
samples of materials and fitting for approval as when required
by the S.O., all samples which are approved shall be the
measure of the standard to be maintained in the execution of
the works.

(v) (a) Not with standing the foregoing, all materials used in or in
connection with the Works shall be obtained from within the
district or state where the Works is situated. Under no
circurmstance shall materials intended for use in or in
connection with Works is situated unless the S.O is satisfied
that these are not procurable from the said district or state.

(vi) (a) The contractor shall place his orders for specified materials
at the earliest possible date after notification of acceptance of
tender or at such times as may be specifically stated elsewhere
here in for any particular materials.
(vii) (b) The Bills of Quantities shall not be used as the basis for
ordering any materials

A GENERALLY
(c) If the Contractor fails for any reason to supply any materials which he has
contracted to supply or if he fails to supply any such materials in suffucuent time to
enable the Contract to be completed by the date fixed for completion, then in
either event the Government may supply any portion or all of such materials. If the
Government supplies such materials the cost in respect thereof which shall be
bourne by the Contractor shall be:-

The Actual Cost to the Government at the rate of Supply plus (+) 25.0% for the
necessary overhead and other charges,
WHICHEVER IS GREATER.
The cost to be borne by the Contractor as above shall be deducted from any
money due or to become due to the Contractor under this Contract and the
Contract Sum shall be adjusted accordingly. No action by the S.O under this
Clause shall be deemed in any way to affect or modify the right of the Government
to a claim for damages in the of the Contractor’s failure to complete.

(a) Notwithstanding anything herein or elsewhere contained, the Contractor
shall engage and/or appoint a competent Site Agent to provide all
necessary superintending over the whole site operation for the full
duration of the Contract and as long thereafter as the S.O. may consider
necessary for the proper fulfilment of the Contractor’s obligations under
the Contract. He must be competent in English and/or Bahasa Malaysia
and be a competent and qualified member of the professional group
(viz. Engineer, Architect or Quantity Surveyor) having a comprehensive
theoretical background, suitable qualification and experience approved
by the S.O.

(b) The Site Agent shall be constantly on the Works and shall devote the
the whole of his time to the superintendence of the Works. Should the
S.O. find him unsuitable for any reason whatsoever, the Contractor shall
as soon as practicable after receiving such written notice from the Site
and shall thereafter employ and/or engage another to the approval of
the S.O

(i) The Contractors shall be fully responsible for all sub-contractors and
any delays or damage thereby occasioned and shall be responsible for
the supervision and administration of all sub-contracts in accordance
with Conditions of Contract and shall be required to arrange for the
execution of and schedule the work with each of nominated firms. The
schedule shall be subjected to the approval of the S.O.
(ii) The Contractor shall allow in his tenders price for the attendance and
facilities upon all nominated sub-contractors and such attendance and
facilities shall include for the following:-
(a) Ascertaining from Nominated Sub-Contractors all particulars relating to
their work in regard to sizes of and positions in which chases, holes,
mortices etc. are required to be formed or left.
(b) Making good of walls, ceilings, floor, roof etc. and finishes thereto
including touching up of all paintwork necessitated, damaged or
distributed by the Nominated Sub-Contractor’s Work
(c) Supplying all setting out information.
(d) Giving all necessary dimensions and taking responsibility for their
accuracy
(e) Affording free and full use of standing scaffolding whilst it remains
erected on the site.
(f) Affording free and full use of storage accommodation for materials,
equipment and plant which area for incorporation into the Works and/or
require protection against weather and deterioration, messrooms,
sanitary accommodation and welfare facilities.

(g) Providing SITE SPACE ONLY for Nominated Sub-Contractor’s temporary


office, workshops, workmen’s accommodation and storage of materials,
tools plant and equipment which are not for incorporation into the Works
and not requiring against weather or deterioration.
(h) Providing temporary water supply, electrical power supply, artificial
lighting paying all fees and charges for fuel, water and electricity
consumed.
(i) Liasing with the relevant supply/service authorities for the expeditious
installation of the connections for permanent water and electricity supplies
in the Works and making available such supplies to the Nominated Sub-
Contractors. Paying all fees and charges for such installation deposits for
such suppliers/services on behalf of the Government and all such
payment made, shall be reimbursed to the Contractor on production of
receipted bills.
(j) Providing a competent personnel in compliance with the Electrical
Inspectorate Regulations 1984 to take responsibility for the operation of
the electrical installation from the time the permanent electricity supply is
made available until testing, commissioning and handling over the Works.
(k) Protecting covering, watching and taking full responsibility for all
Nominated Sub-Contractor’s work and unfixed materials and good
intended for use thereon.
(l) Removing rubbish and debris off the site and cleaning the works
internally and externally.
(iii) It is deemed that the Nominated Sub-Contractor will include in the Sub-
Contract Sum, inter a lia, costs in connection with the following:-
(a) Unloading, getting in, storing and all handling and hoisting of his
materials, plant and tools into required positions.
(b) Providing, erecting, maintaining and removing of all his temporary office,
workshop and workmen’s accommodation including paying all
assessment and other charges.
(c) Connecting to temporary water and power supplies made available by the
Contractor for the execution of the works, supplying and running
distribution pipes, hoses, cables, leads, electrical gear etc but excluding
payment for water and electricity consumed.

1.0 Setting Out

1.1 Before commencement of the Works, the Contractor shall employ a qualified and
licensed Land Surveyor to set out anf to confirm points and bench marks, including
all necessary labour, rods, pegs, instruments and attendance required by the S.O
for purposes of checking.
1.2 The Land Surveyor shall locate the correct boundary stones demarcate the site
boundaries, record the site levels, demarcate the building lines, the alignments and
the extent of infrastructure Works and confirm all necessary points.
1.3 The Contractor shall submit two (2) certified signed by the Land Surveyor, as built
surveyed setting out plan, on completion of the setting out.

2.0 Planning and Scheduling

2.1 The Contractor shall submit to the S.O for his approval programme using latest
Microsoft Project, showing the order of procedure and method in which the
Contractor proposed to carried out the works and shall whenever required by the
S.O’s representatives, furnish for his information particulars in writing of the
Contractor’s arrangements for carrying out of the works and of the constructional
plant and temporary works, if any, which the Contractor intends to supply, us or
construct as the case may be.
2.2 The submission to and approval by the S.O or the S.O’s representatives of such
programme or the furnishing of such particulars shall not relieve the Contractor of
nay of his duties or responsibilities under this contract.

3.0 Progress Report

3.1 The Contractor shall prepare and submit daily progress report for the work at monthly
and weekly basis intervals. The S.O representatives shall validate the reports and
the Contractor shall make all amendments required to the report. The Contractor
shall allow for making three (3) colour copies of these report the distributions to all
parties. The Contractor shall prepare, maintain, coordinate and control the planning
programming, scheduling and time implications of his project responsibilities.

4.0 Progress Photograph

4.1 The Contractor shall provide coloured progress photographs size 4R showing
different angle of the site and the associated external works as instructed by the
S.O and shall be taken at monthly intervals during the currency of the contract.

5.0 Printing and Binding of Contract Document

5.1 The Contractor shall prepare six (6) set of Document and submit the completed
Contract Document to the Majlis Perbandaran Nilai.

6.1 The Contractor shall mobilise all mechanical plant required of such type and
suitable to type, nature and method of working for the Works and sire conditions
where the Works are to be executed.

B TEMPORAY WORKS
1.0 Temporary Building

1.1 The Contractor shall provide and maintain temporary office and sheds, for use
during the execution of the works, at the locations as approved by the S.O relocate
and re-erection if necessary, remove them on completion of the works and pay all
charges in connection therewith.
1.2 These sheds and the fixtures therein shall remain the property of the Contractor on
completion.
- Adequate lock-up weather proofed shed for safe storage of building material.
Sheds for storage of cement shall have the floor raised at least 300mm above
ground level.
- Adequate sheds and messrooms for workmen with adequate lighting and
ventilation all to the approval of the Local Authorties.

2.0 Temporary Lighting and Power

2.1 The Contractor shall provide adequate temporary lighting and electrical power
including the use of generator sets for use on the Works including any normal power
required by all Nominated Sub-Contractors and for testing, test running and
balancing of all Specialist Installations included in this Contract, pay all charges and
clear away apparatus on completion.

3.0 Temporary Water Supply


3.1 The Contractor shall allow for providing his own water supply including the
construction of wells, if necessary. The Contractor shall maintain and clear away
on completion all temporary water source, plumbing and storage of all water
required for use in the Works and shall pay all costs and fees in connection
herewith. All water shall be fresh, clean and free from deleterious matter.
Contractor is advised to find out potential source of water before submitting
tender.

4.0 Project Sign Board


4.1 The Contractor shall provide and fix in position within one (1) week of the Date of
Site Possession the Project Sign Board approved by the S.O with the required
wordings and design.
4.2 The sign board shall be maintained and adapted as required by the S.O and shall
be dismantied, removed ad make good to the satisfaction of the S.O.

5.0 Temporary Hoarding And Gate


5.1 Maintain temporary fencing, hoarding, gates, fans, planked foor ways, guard rails,
gantries, safety netting, warning lights and noties for protection of the public and
the occupants of any adjoining premises and for meeting the requirement of any
Local Authority. After, shift and adapt from time necessary and clear away on
completion temporary 810m length metal hoarding with approved logos must be
constructed around the perimeter of the construction site.

6.0 Damage and unkeeping existing roads, paths and etc.


6.1 The Contractor shall be responsible for damage to the surface of existing roads to
verges, ditches, drains, culverts and fences which may result from his work or
from the passing of his vehicles, plant or equipment or whatever kind to and from
the same damage immediately it occurs and he shall reinstate eh same to their
original condition all to the satisfaction of the awners of the road or property over

B HEALTH, SAFETY, SECURITY & ENVIRONMENTAL

1.0 First Aid Kit

charge of either the Contractor’s site representatives or some other responsible
person who will be on the site during all working hours to ensure that the First Aid
facilities are available without delay at all times when work is in progress.

PREAMBLE TO DAY WORK RATES


Any work ordered by the Superintending Officers (S.O.) to be carried out by day work shall be paid for
at the rate entered hereunder subject to the following conditions:-

1. The rate entered for labour shall be deemed to include all on costs associated with the
employment of such labour including ( inter-alia), head office chargers, overhead chargers,
profit, site expenses subsistence allowances, time lost due to inclement weather, bonus,
holiday and sick pay, and any other employee’s fringe benefit(s), small tools and
consumables stores temporary equipment such as wages, temporary tracks, ladders staging
scaffolding and all items of a similar nature unless there are provided or set up exclusively for
day work.

2. The wages of gangers and leading hands working with their gangs shall be paid for at the
appropriates rates, but the time of walking gangers, sub–foreman and foreman will be
included in the rates entered for labour under site supervision and staff.

3. Payment of overtime work, if chargeable and approved by the S.O. shall be made at the rate
entered herein, but the time so worked as overtime shall be adjusted in the same proportion
as that used for paying the normal workers on the site and approved by the S.O. Thus is a
man works 1-hour overtime for which the rate payable is double time, payment shall be made
for 2 hours at the rate entered in the day works schedule.

*Note: Overtime is working time over and above 8 hours per working day including Saturday
or 48 hours per week.

4. The special cost of special watching and lighting necessitated by day works shall be included
in the rates.

5. The rate entered for plants shall apply only to plant which the contractor has available in the
site. Such rates shall be deemed to include all over head charges, profits, site supervision
and staff, hire chargers fuel, maintenance, consumable stores, spare parts, insurances etc.
but shall exclude the cost of wages for drivers and operators, which shall be payable
separately as dealt with under paragraph 1 above.

6. Payment for mechanically operated plant shall be made only at such times as the plant is
engaged in day work and shall exclude all standing, idle or down time.

7. If any worker or items of plant on day work do not readily belong to any classification included
in the schedule or inserted by the contractors at the time of tendering, the S.O. shall
determine the equivalent classification to be adopted for such worker or items or plant and
payment for such will be made accordingly.

8. The rate inserted by the contractor shall be realistic rates in conformity with those on which
his tender has been based, and shall be based on conditions prevailing at the time of tender
but bearing in mind that claims for escalation will not be entertained.

9. The rate inserted by shall be subject to agreement with the S.O. as to their reasonableness
and subject to such agreement shall be used as day work rates.

10. The day work rates entered hereunder and agreed by the S.O. shall not be further subject to
the fifteen percent (15%) addition as stipulated in clause 25(d) of the condition of contract.

11. The Contractor shall produce for verification to the S.O. vouchers specifying the time and
materials employed on the work, if required, the contractor shall also produce his receipted
bills and wages books in support of his accounts.

12. Where special mechanical plant is required for use on day works, the cost to be paid to the
contractor shall be subject to agreement by the S.O.

13. Only time on work actually done will be allowed. A “day” is considered to be normal working
day of 8 hours. Fraction of day will be paid for pro-rata.

14. Rates for power driven tools are not included in the labor rates but changes for hand tools
shall be deemed to be included.
