Four Parts of an Ordinance:

1. Declaratory
2. Directory
3. Remedial
4. Vindicatory

Other parts:

2. Title and subject (Ledasan v. COMELEC)
3. Preamble (Whereas Clauses or Explanatory note)- Aglipay v. Ruiz
a. To introduce the subject matter of the ordinance.
b. The reasons or the motivations of why you are drafting the ordinance.
c. Legal basis if any
4. The Enacting Clause- authority from which the statute emanates
a. “Be it enacted”
b. “The Sangguniang Panlungsod of the City of Cebu on session assembled, hereby
ordains”
5. The Purview or Body
a. Ordinances shall be in articles and sections
b. It can be one substantive section
6. The Exceptions and Provisos
7. Interpretation Clause
8. Penalty Clause (if penal, one year effectivity)
9. Separability, Repealing, and Saving Clauses

- The title of an ordinance need not be an index of what the ordinance is about.
- If amending an amendatory ordinance – “further”.

Proceedings before passing an Ordinance:

1. First Reading:
a. Upon receiving the bill, the secretary reports it to the Sanggunian at the next
session thereof for its first reading.
b. Immediately after first reading, the bill is referred to the proper committee.
c. The Committee studies the bill and then reports it back to the House so that it
may be included in the calendar.
2. Second Reading:
a. On the day fixed for the consideration of the reported proposed ordinance, the
same is read in full by the secretary for the second time with amendments
proposed by the Committee.
b. The second reading may be dispensed with by the majority vote of the house. It
is at this stage that the proposed ordinance is opened for debate. Then comes
the period for the introduction of amendments.

3. Third Reading:
a. Voting
b. There should be a copy of the final draft before the final reading

Public Hearing
- Money
- Penalty involved
- After the Committee files a report and before the second reading
- Even if the public does not approve of the ordinance, the SP can still push for the
passage of the ordinance.
- It’s still a public hearing even if no one appears
