Emin = saa ) suREAT OF IMMIGRATION See 19 MANILA OPERATIONS ORDER NO, 3HM-2019-_008 IMPLEMENTING RULES ON SPECIAL WORK PERMIT ‘AND PROVISIONAL WORK PERMIT WHEREAS, CA No, 613, Sec. 42(a}(33) authorizes the Commissioner of Immigfation to issue Special Work Permits (SWP) and Provisional Work Perts (PW) to forelgners who seek to work in the county for & short period of Ue while ‘okding & Temporary Visitor Visa (TW) under CA 613, Sec, 9(2} or £.0. No. 408; WHEREAS, under the 01 May 2019 Joint Guidelines (26) of the Department of Lebor and Employment (COLE), Department of Justice (DOI), and Bureau of Immigration (BI), the BT shall issue SWP and PW to foreign national enabling them fo work is the Philippines for 2 maximum period of six (6) months. WHEREAS, Sec. 2. of the 3G defined SWP as a permit to work issued by the ‘Bureau of Iroigration which allows foreign natonaisto engage in work outside of an employment arrangement, while PWP is defined os = permit to work Issued by the Bureau of Immigration which allows foreign nationalsto engage in work Pursuant to an employment arrangement pending Issuance of thelr Alien Employment Permit (AEP) and CA 613, Sec. 9g) work visa; NOW THEREFORE, pursuant to the rule-making power of the Commissioner of Immigration under CA 643, Sec. 3, and Executive Order No. 292", Tile I, Book WV, Chapter 6, Secs, 29 and 36, the following rules are hereby promulgated: Section 1. Professional athletes, coaches, trainers and assistants; International performers with exceptional ablities; Attists, performers and their staff, who perform before an audience for @ fee, subject to compliance with the requirements of the concemed agency, office oF body; « ‘4. Service suppliers coming primarily to perform temporary services and who do not receive salary or other remuneration from a Philippine source other than expenses Incidental to thelr temporary stay, 5. Treasure hunters authorized to search for hidden treasure with perma from the concemed government agencies and instumentalities; 6, Movie and television crews authorized to film in the country by the relevant ‘egulatory office, body or agency; 7. Forelgn journalists practicing their profession or covering a specific event In the county 8 9. Trainee/s assigned in government instrumentaltes, government owned and ‘controlled corporations (GOCC) and private entities; Lecturers, researchers, trainers and others pursuing academic woek, who. ‘re assigned in schools, unlversiies, educatonal and research inetiutions, government agencies and other entities (with or without compensation), 10. Religious missionaries and preachers; 11. Commercial models and talents; 12, Culinary spectaliss/Chets; 13. Professionals; and 44, Consultants or specialists, 1. Photocopy of ‘Allen Employment Permit (REP) with photocopy of the ‘application for CA 613, Sec. 9(6) work visa or the official receipt of the ‘application for an AE 5. Fer Corporations or Partnerships, photocoples of the following: 2. Securities and Exchange Commission (SEC) Certificate of Registration; 1b. _Aticles of Incorporation; €. Photocopy of the applicant's Taxpayer Idenuincation Number (TIN) card or any proof of TIN; 10, Special Temporary Permit. issued by the Professional Regulstion Commission, when warranted (posttions/professions classified as regulated profession by the PRC), and 11. In case of consultant or specialist, 3 justification that despite thelr best efforts, 10 Filipino 1s able and willing to provide such consultancy of specialized service; 12. BI Clearance Certificate, Section 7. Pariod of SWP and PWP. -SWP and PWP shall be for a ‘maximum period of six (6) months, non-renewable, with an inal duration of not ‘more than three (3) monthsplus final three (3) mionth period when applied for. Section $. Refugees and Other Classes of Allens. ~The right t work ranted by or recogrized in treaties, laws, and other regulations in favor of (a) refugees; (0) foreigners engaged 0 work in government projects. with foreign - fundings; and (c) such other cases of allens shall not be impaired. Section 9, Authority to Receive and Process. ~ Bt Officers authorized to receive and process and approve ‘SWP and PWP applications under Immigration ‘Administrative Circular No, JHM-2018-003" shal observe the folloing procedure: 4, Reoaive applications for SWP and WP with a completely filed-up Consolidsted General Application Form (CGAF) together with the ‘complete documentary requirements, 2. Assess and determine base on the following submited requisites, to xastence and capeblity of petitioning company; ‘Address of the company and applicant (residence); Nature of Business of the pettioning company as reflected in its SEC Certificate; and . Determine whether the company has a valid appropriate ‘government issued license to operate; a see 3. Upon assessment and verification, the Alen Control Officer (ACD), Acting ‘Alen Control Officer (ACO), or duly authorized personne! shall resolve whether to approve oF dlsepprove the SWP or PW application, Section 10. Approving Authoslty for SWE/PWP applications. ~The ‘Commissioner or his duly authorized personnel is authorized to approve/disapprove 'SWP/PWP applications filed within their area of jurtadkction. Section 11. Duty of Approving Officer. — The approving officer shat censure that all SWP/PWP applications he appraved/disapproved are duly reflected in {the system with the applicant's TIN. Section 12, Invalidity of SWP/PWP, ~ Aay violation of the terms and conditions of SWP/PWP and any misrepresentation wil render the permit Iwvalld and may subject the SWP/PWP holder to deportation proceedings, Section 13.
