A Czech sporting skydiver Jiži K. participated in a skydiving competition in Poland.

A photographer
from one of Polish magazines photographed him just after landing. The photo was published a month
later, next to an article on the Polish special forces unit “GROM”. The caption suggested that the
picture presents soldiers exercising on a military training ground. Because of difficulties he has faced
for this reason in his home country, Jiži K. plans to submit a claim to a Polish court for remedying the
infringement of his personal rights by way of a declaration that the photograph was published in an
untrue context. Moreover, he intends to claim compensation of PLN 100,000 and PLN 50,000, to the
benefit of the Czech and the Polish sporting parachuting associations respectively. Does the Polish
court have jurisdiction in this case? Which law will be applicable to issue the judgement on the
protection of his personal rights? Which law will apply to the adjudication of compensation and the
potential payment of the relevant amount for the specified cause?
