FACTS:
A vehicle of Asian Land Strategies Corporation arrived at the house owned
by Lolita M. Lapore. During that time, March 31, 2008 at around 8:30 in the
evening two guards alighted the van and ordered her sons Enrique Lapore
(Bong) and Benhur Pardico (Ben) to come with them at the office of the
security department. A complaint was filed against Bong and Ben wherein
they allegedly stole the light bulb from one of the lamp posts in the
subdivision. In their defense, they merely transferred the said light bulb
since their father has been complaining about the defective lamp post near
their home and the subdivision was not doing anything to address it. They
were then released afterwards and to serve as evidence for their release
Lolita was made to sign in the logbook.

They were then invited at the Malolos Police Station on April 17, 2008 with
regard to the complaint that Benhur Pardico, husband of Virginia Pardico in
was then missing. Consequently they filed a Petition for Writ of Amparo
before the Regional Trial Court which was then granted and affirmed by the
appellate court.

ISSUE:
Whether or not there were proper grounds for the issuance of the Writ of
Amparo.

RULING:

There were no proper ground for the issuance of the Writ of Amparo. The
respondents failed to establish that the disappearance of Ben was not by
virtue of his arrest. The proof of his disappearance was not sufficient to
invoke that there was a threat to his right to life, liberty, and property.
Furthermore, Asian Land Strategies Corporation is not in anyway affiliated
by the government.
