It is not (necessary) for all the believers to go forth. So, why should it not be that a group from
every section of them goes forth, so that they may acquire perfect understanding of the Faith, and
so that they may warn their people when they return to them, so that they may take due care (of
the rules of Shari‘ah ). ( اﻟﺘﻮﺑﺔ122)

Fiqh
Meaning to fiqh: ﻓﻘﮫ ﯾﻔﻘﮫ
To understand and comprehend
The word hadith (something new and created) linguistically is the opposite of qadeem
(something ancient and old). As a technical term it refers to whatever is associated with the
Prophet ص ّلي اهلل عليه وس ّلمfrom his sayings, actions, approval, character, and even his movement
while being awake or asleep
Need of Hadith
1. The Quran has mentioned teaching and explaining “the book” as one of the prime
responsibilities of the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢ:
َ ِ َّﻚ اﻟ ِّﺬﻛ َْﺮ ﻟِﺘُﺒ ِّﲔ ﻟِﻠﻨ

َ َ
And We sent down the Reminder (The Qur’an) to you, so that you explain to the people what has
been revealed for them, and so that they may ponder.
4. The Quran has many concise rulings the details of which are found within hadith. For
example: Salah, Sawm, Hajj, Nikah, Talaq, Business dealings , etc.
5. Lastly, the proof that the Quran is the Quran is also learned from hadith

Shaikh Wali Ud Deen Al Iraqi was asked:
Is knowledge of the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢbeing a human and an arab a condition for the correctness of
faith or is it a collective duty (Fard Kifayah)?
He replied: Indeed it is a condition for the correctness of faith!
Then he said: If a person says
‘I believe in the prophethood of Muhammad ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢtowards all creation but Im not sure If he is a
man, an angel, or a jinn nor am i aware of him being an arab or non-arab’
then there is no doubt in this persons disbelief for falsifying the Qur’an and rejecting what generations of
Islam have narrated from their predecessors which became a necessary knowing for the public and
scholars.
I do not know of any difference of opinion existing in this (disbelief). If a person is unaware, it will be
incumbent to learn this (creed) but If someone is to deny after knowing, we will have to deem them
(disbelievers) due to their kufr (disbelief).

• When someone believes is Allah that means he is admitting to accept all of Allah’s
commands
• We have no right to pick and choose
• We have to submit fully to Allah subhanahu wa-ta’ala.
Shariah has declared this as filth though it is not observable, such as being in need of ablution or
a bath. There are two types of Najasah Hukmiyah:
a) Hadath Asghar (Being in need of ablution). All those things which render the
ablution invalid are included in this (i.e breaking wind, bleeding, using the bathroom,
etc.) and
b) Hadath Akbar (being in need of a bath). All those things which require a bath to
cleanse oneself are included in this (i.e sexual intercourse, wet dreams, etc.)

The Prophet ( )ﷺsaid, "Avoid the seven destructive things." It was asked: (by those present):
"What are they, O Messenger of Allah?" He replied, "Associating anyone or anything with Allah
in worship; practising sorcery, killing of someone without a just cause whom Allah has
forbidden, devouring the property of an orphan, eating of usury, fleeing from the battlefield and
slandering chaste women who never even think of anything touching chastity and are good
believers.”
An Amazing fact:
Surah Mohammad is named after the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢwhich is surah #47. Sarah Nasr
talks about the demise of the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢwhich is surah #110. 110 - 47 = 63 which
is the age the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢpassed away.

There are two classifications of filth:
1. Insubstantial Filth (Najasah Hukmiyah)
2. Substantial or True Filth (Najasah Haqiqiyah)
All those things which require a bath to
cleanse oneself are included in this (i.e sexual intercourse, wet dreams, etc.)
a) Najasah Ghaliza is major filth, such as urine, excrement, wine, blood etc.
b) Najasah Khafifa is minor filth such as urine of halal animals, etc.

Major Filth (Najasah Ghaliza)
Human urine and urine, excretion of animals, urine of forbidden animals, flowing blood of
humans and animals, the droppings of chickens and ducks and wine are all considered major
filth.
Ruling: If its spread is less than the size of a dirham, it is forgivable. But if it is equivalent to or
greater than the size of a dirham, then it is not permissible to offer Salah without washing it off.
“Frogivable means that if an individual offered Salah with this amount of filth on his body or
clothes, his Salah, though undesirable, will be valid. It is not desirable to purposely leave even
this small amount of filth on the body or clothes before offering prayer.

Method of Cleaning & Purifying Soiled Body & Clothes
Visible filth, such as blood and feces, may be washed away from the body or clothes until it is
clean regardless of the number of washings. Even if spots remain or smell linger, it would be
considered clean as long as it is washed sufficiently so that the filth does not appear while rinsing
the garment.
For the invisible filth, such as dried urine, etc. the body part of the garment should be washed
three times.
It is necessary to rinse the clothes after each wash. If washing clothes in a washing machine, the
machine should be such that it rinses the clothes with fresh water three times. Other liquids may
also be used to wash and clean instead of water.

1. Cleaning things that cannot be rinsed
Carpets and other heavy materials that cannot be reached easily maybe clean from filth
by using carpet cleaning machines as long as the water is sprayed and sucked up from it three
times.
If a carpet cleaning machine is not available the area maybe clean by manually washing
his three times and letting it dry sufficiently between each wash so that the water stops dripping
from it.
3. Cleaning solids
Things are quite sick or solidified such as butter yogurt honey jams etc. maybe clean
from filth by simply removing the contaminated part the rest of it will be clean.

1. what is the ruling about cleanliness of a garment that has come in contact with a dog?
A dog saliva is impure. Therefore the garment will be considered clean as long as it
hasn't been soiled by saliva. If it is soiled with saliva washing the affected part will render it
clean.
The same ruling will apply as for adults that is if the vomit is a mouthful it will be
unclean.
5. If someone notices filth on his clothes and doesn't know when it became soiled how should he
determined how long his clothes have been soiled?
Consider the probabilities in the near past. For example if it appears to be urine or feces the last
time a toilet was used will be the probable time of contamination. It appears to be semen than
the last time the person I woke from sleep will be the probable time. if a probable time cannot be
determined then the time one notices the filth would be the time of contamination.

Small children can be careless about getting soiled. If they put their hands in a pot of water,
would it be considered clean or not?
The water would be considered clean unless there is evidence of the child’s hands being
unclean.

At the time of relieving oneself one should be very careful not to let the filth splash and soil the
body or clothes. If one gets soiled one should clean the body parts and the parts of the clothes
properly. Punishment in the grave results from not protecting oneself from urine splashes.
While on the toilet a while relieving oneself one should not recite the names of Allah or the
Koran. Also one should not respond if someone greets him or her with salaam.
One should take water with them to the toilet if there is no water in there. If an elder intends to

a dispute arose about who was going to put the hajar-aswad back in its place, everyone
agreed that the first person to enter the haram the next day would decide who would place it.
The next morning, the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢwas the first to enter. Everyone was happy

• Angels are the creation of Allah - They worship Allah alone
• Allah created the Angels out of Noor (light)
• Angels don’t disobey Allah and fulfill the responsibilities that Allah has ordained for them
Allah has said in the Quran:
[6 :ﻭﻥﹶ{ ]ﺍﻟﺘﺤﺮﱘ3ﻣ'ﺮ#ﺆ3 ﻭ'ﻳ'ﻔﹾﻌ'ﻠﹸﻮﻥﹶ ﻣ'ﺎ ﻳ#ﻢ3ﻮﻥﹶ ﺍﻟﻠﱠﻪ' ﻣ'ﺎ ﺃﹶﻣ'ﺮ'ﻫ3ﺼ#} ﻟﹶﺎ ﻳ'ﻌ
Who do not disobey Allah in what He orders them, and do whatever they are ordered to do.
• Allah has ordained different tasks for the angels. Some are praising Him, some bowing,
some in prostration, some protecting humans, some writing deeds, some search for the
gatherings of remembrance, some praying for the pious, some asking for forgiveness, some
are the caretakers of the water, some over air, some over clouds, some over mountains etc.
• No one knows that exact number of angels but Allah. All we know is that there are a lot of
them that exist. This is understood from a hadith where the Prophet ﺻﻠّﻲ ﷲ ﻋﻠﯿﮫ وﺳﻠّﻢsaid: I
see what you do not see and I hear what you do not hear; heaven has squeaked and it has the
right to do so. By Him, in whose hand my soul is, there is not even a space of four fingers in
which there is not an angel who is prostrating his forehead before Allah, the exalted.
• 70,000 angles do tawaf of al-bait al ma’moor every day.
Fiqh
1. How much water should be used for Istinja?
There is no set amount of water for istinja. One should use as much water as necessary to
wash off the filth satisfactorily without wasting water.
2. Can a person whose left hand is handicapped, use his right hand for istinja?
It is permissible for a person whose left hand is handicapped to use his right hand for this
purpose without any reservation.
3. Can another person wipe and clean a person who is so ill or handicapped that he is not able
to clean himself?
If a person is so ill or handicapped, then the spouse may wipe and clean him/her. If
someone besides the spouse must help them, then two conditions must be met: 1) he/she
must not look at the private parts of the person being cleaned, and 2) He/she must not touch
the private parts. If these conditions can not be met, then he/she may bra without being
cleaned.
4. Whenever I offer my Salah, I feel that some drops of urine come out. What is the ruling of
Shari’ah in this regard?
After urinating, clean yourself properly before making ablution. Doubt in itself does not
break the ablution. Doubt in itself does not break the ablution. The devil often tries to
receive people by introducing such thoughts. Therefore, unless one is certain about
discharging drops of urine, they should not break their Salaah.

Those who take riba (usury or interest) will not stand but as stands the one whom the
demon has driven crazy by his touch. That is because they have said: “Sale is but like
riba.’’, while Allah has permitted sale, and prohibited riba. So, whoever receives an
advice from his Lord and desists (from indulging in riba), then what has passed is
allowed for him, and his matter is up to Allah. As for the ones who revert back, those are
the people of Fire. There they will remain forever. (275) Allah destroys riba and
nourishes charities, and Allah does not like any sinful disbeliever. (276) Surely those who
believe and do good deeds, and establish Salah (prayer) and pay Zakah will have their
reward with their Lord, and there is no fear for them, nor shall they grieve. (277) O you
who believe, fear Allah and give up what still remains of riba, if you are believers. (278)
But if you do not (give it up), then listen to the declaration of war from Allah and His
Messenger. However, If you repent, yours is your principal. Neither wrong, nor be
wronged. (279) If there is one in misery, then (the creditor should allow) deferment till
(his) ease, and that you forgo it as alms is much better for you, if you really know. (280)

Context of revelation
A'isha reported:
that a Jew from among the Jews of Banu Zuraiq who was called Labid b. al-A'sam cast a spell
upon Allah's Messenger ( )ﷺwith the result that he (under the influence of the spell) felt that he
had been doing something whereas in fact he had not been doing that. (This state of affairs
lasted) until one day or during one night Allah's Messenger ( )ﷺmade supplication (to dispel its
effects). He again made a supplication and he again did this and said to 'A'isha: "Do you know
that Allah has told me what I had asked Him? There came to me two men and one amongst them
sat near my head and the other one near my feet and he who sat near my head said to one who sat
near my feet or one who sat near my feet said to one who sat near my head: What is the trouble
with the man? He said: The spell has affected him. He said: Who has cast that? He (the other
one) said: It was Labid b. A'sam (who has done it). He said: What is the thing by which he
transmitted its effect? He said: By the comb and by the hair stuck to the comb and the spathe of
the date-palm. He said: Where is that? He replied: In the well of Dhi Arwan." She said: Allah's
Messenger ( )ﷺsent some of the persons from among his Companions there and then said:
"'A'isha, by Allah, its water was yellow like henna and its trees were like heads of the devils."
She said that she asked Allah's Messenger ( )ﷺas to why he did not burn that. He said: "No,
Allah has cured me and I do not like that I should induce people to commit any high-handedness
in regard (to one another), but I only commanded that it should be buried.”

Abu Hurairah (May Allah be pleased with him) reported:

• As people slowly started accepting Islam a small group of Muslims was formed. This small
group used to gather in Darul Arqam until Sayyiduna Umar رضي اهلل عنهaccepted Islam. After
he accepted Islam, the muslims used to gather wherever they wished.
• It was during this time that the leaders of Makkah started to show some annoyance and
discontentment to the Prophet ص ّلي اهلل عليه وس ّلمcalling towards Islam. Before this they did
not care much about what the Prophet ص ّلي اهلل عليه وس ّلمwas doing. When they saw Islam
gain some strength, this heedlessness turned into apprehension that this call to Islam might
spread and change the present mentality.
• For the first three years of Prophethood, the Prophet ص ّلي اهلل عليه وس ّلمused to secretly call
towards Islam. There after the Prophet ص ّلي اهلل عليه وس ّلمwas commanded to call people to
Islam openly.
• When the Prophet ص ّلي اهلل عليه وس ّلمreceived this command, he went and climbed mount
Safaa and called all of the tribes of Quraish. When they all arrived, the Prophet ص ّلي اهلل عليه
وس ّلمasked them, “if I tell you there is an army coming to attack us on the other side of this
mountain, will you believe me?” They all replied in the affirmative. The Prophet ص ّلي اهلل عليه
وس ّلمsaid, “Verily I warn you of a severe punishment.” Many people became angry that they
were only called fro a matter they felt was insignificant.
• The Prophet ص ّلي اهلل عليه وس ّلمcalled him family members from Banu Al Muttalib for food to
call them towards Islam. During the first meeting with family member, the Prophet ص ّلي اهلل
عليه وس ّلمdid not get a chance to address them. Hence the Prophet ص ّلي اهلل عليه وس ّلمcalled
them a second time where he invited them to the oneness of Allah. His uncle Abu Talib
promised to protect the Prophet ص ّلي اهلل عليه وس ّلمbut did not accept the message. On the
other hand, the Prophet ’ص ّلي اهلل عليه وس ّلمs uncle Abu Lahab showed his opposition harshly.

Belief in the Hereafter
• Our belief is that everyone is to be resurrected after death and will have to account for his/her
deeds. Thereafter they will enter Paradise or Hell in accordance to Allah’s decision.
• There are some oppressors and some oppressed in this world. If someone doesn’t receive
justice in this world, they will in the hereafter regardless of their faith or the oppressor’s
faith.
• At the time of death when a person sees the Angel of Death, the opportunity to repent ends.
