RESOLUTION NO. _ 2020-252
CONFIRMING THE SPECIAL PROMOTION ORDERS OF THE FOUR THOUSAND
TWO HUNDRED TEN (4,210) PNP MEMBERS WHO WERE MERITORIOUSLY
PROMOTED BEFORE JUNE 30, 2007 FOR PURPOSES OF PERMANENCY
IN THE STATUS OF APPOINTMENT
WHEREAS, Section 33 (b) of Republic Act 8551 provides that "Any uniformed
member of the PNP who has exhibited acts of conspicuous courage and gallantry at the
risk of his / her life above and beyond the call of duty, shall be promoted to the next
higher rank: Provided, That such acts shall be validated by the Commission based on
‘established criteria,”
WHEREAS, the PNP, prior to June 30, 2007, has issued Meritorious Promotion
Orders ahead of the prerequisite validation of the meritorious act by the National Police
Commission (NAPOLCOM) and the subsequent attestation of the corresponding
appointments by the Civil Service Commission (CSC),
WHEREAS, there were also cases wherein Meritorious Promotion Orders were
already issued and appointments were subsequently attested by Civil Service
Commission (CSC), but the meritorious acts were not validated by the NAPOLCOM
and / or later disapproved by the same for failure to meet the established criteria on the
grant of special promotion;
WHEREAS, many of the grantees of Said Meritorious Promotion Orders were
issued appointment in temporary status due to lack of appropriate eligibility and
education requirement pursuant to NAPOLCOM Memorandum Circular No. 98-03 which
was the policy in effect then;
WHEREAS, NAPOLCOM Memorandum Circular No. 98-03 was amended by
Memorandum Circular No. 2007-003 that repealed all the qualification standard
requirements (education, eligibility, training and experience) on meritorious promotion
for Police Non-Commissioned Officers (PNCOs) and repealed the qualification standard
requirement of experience for Police Commissioned Officers (PCOs),
WHEREAS, the NAPOLCOM, based on the premise that it is discriminatory to
exclude police officers with temporary appointments to be meritoriously promoted,
issued Memorandum Circular No. 2008-002 which repealed the provision that
temporary appointment is a disqualification for special promotion;
WHEREAS, the issuance of NAPOLCOM Memorandum Circular No. 2008-002
did not resolve the predicament of the PNP personnel concemed as the same issuance
is applied prospectively, and therefore appointments issued before the effectivity of MC
No. 2008-002 remained in temporary status which disqualifies them for regular
promotion;
WHEREAS, the NAPOLCOM and the PNP have recognized the fact that many of
the subject PNP personnel have long carried their promotions and have continuously
enjoyed the equivalent salary adjustments up to present, but remained ineligible for
regular promotion because of lack of permanent appointments attested by the CSC;
likewise, there are police officers, while waiting for the final resolution of their
meritorious promotion, were already promoted through regular promotion;WHEREAS, in a meeting held on February 21, 2008 amongst representatives of
the NAPOLCOM, PNP and CSC, a recommendation was adopted that an amnesty
from the prescribed requirements be granted to PNP personnel who were issued
Meritorious Promotion Orders up to June 30, 2007, under the following categories:
a. Issued Meritorious Promotion Orders with SPADB Resolutions but without
validation by the NAPOLCOM;
b. Issued Meritorious Promotion Orders with SPADB Resolution but denied by
the NAPOLCOM;
c. Issued Meritorious Promotion Orders with SPADB Resolution and validated
by the NAPOLCOM,
d. Issued Meritorious Promotion Orders without SPADB Resolution and without
validation by the NAPOLCOM,
8. May 1 with Issued Meritorious Promotion Orders but without NAPOLCOM
validation;
f, May 1 with Issued Meritorious Promotion Orders and validated by the
NAPOLCOM;
WHEREAS, the PNP, after series of consultative meetings with the NAPOLCOM,
submitted a list of PNP personnel who are proposed to be granted such amnesty
through confirmation by the NAPOLCOM of their Meritorious Promotion Orders:
WHEREAS, a total of four thousand two hundred ten (4,210) PNP personnel are
expected to benefit from the confirmation of meritorious promotion orders;
WHEREAS, the Commission, after consideration of the proposal of the PNP,
finds the same tenable based on the assertion that the police personnel concerned are
in a predicament not of their own doing but because of administrative lapses and
dysfunctions which happened in the past,
NOW THEREFORE, the Commission, in the exercise of its constitutionally
Mandated authority of administrative supervision and control over the PNP, HAS
RESOLVED TO CONFIRM, AS IT HEREBY CONFIRMS, the special promotion orders
of the four thousand two hundred ten (4,210) PNP members who were meritoriously
promoted before June 30, 2007 for purposes of permanency in the status of
appointment, attached as Annex “A”
RESOLVED, FURTHER, that the confirmed Meritorious Promotion Orders shall
be subject to the following conditions:
1. The effectivity date of the confirmed Meritorious Promotion Orders of those
who remained in their rank and were not promoted through regular promotion
shall be on the date of the heroic act, while those who were already promoted
through regular promotion may request to amend the date of the effectivity of
their confirmed Meritorious Promotion Orders to the date of the meritorious
act but only for documentation purposes;
2. The time-in-grade of those who were already promoted prior to the
confirmation of their Meritorious Promotion Orders shall be based on the date
of attestation of their recent appointments acquired through regular
promotion; and
3. The confirmed Meritorious Promotion Orders shall not be used as basis to
claim for back wages.RESOLVED, FURTHERMORE, that this Resolution shall take effect on
May 11, 2010;
RESOLVED, FINALLY, that a copy of this Resolution be furnished the Civil
Service Commission for their appreciation and reference
