CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease is made and executed by:

________________________, of legal age, married, Filipino, and with


residence and postal address at Dumaguete City, Negros Oriental hereinafter
referred to as the LESSOR.

AND
_______________, of legal age, married, Filipino and with residence and
postal address at Dumaguete City, Negros Oriental, hereinafter referred to as
the LESSEE.

WITNESSETH;

1. That the LESSOR, as owner of a parcel of land located at Junob,


Dumaguete City, hereby agrees to lease the said lot with an area of
700 square meters, more or less unto the LESSEE.

2. That in consideration of the monthly rental of THIRTY THOUSAND


PESOS (P30,000.00)Philippine Currency net of VAT and
withholding tax, for a term of Fifteen (15) years, renewable upon
agreement of the parties with an escalation rate of 10% for every 2
years.

3. That the LESSEE shall pay One (1) year advance or THREE
HUNDRED SIXTY THOUSAND PESOS (P360,000.00) Philippine
Currency, upon execution of this contract.

4. The lease shall commence on ______________ 2019 to ___________, 2034.

5. That the LESSEE shall be allowed to construct a building suitable for


her business;

6. That after the expiration of the lease, the LESSEE shall be allowed to
get the pump dispenser and other movable property and left the
building and structures in the leased property;

7. The LESSOR shall undertake that the term of this Lease shall not be
affected by any change in the ownership of the Leased Premises. In the
event that the LESSOR shall decide to sell the Leased Premises subject
of this lease, the LESSOR must first offer the sale of the Leased
Premises to the LESSEE.

8. The LESSEE may, without any penalty, pre-terminate this Lease


unilaterally, upon prior written notice to the LESSOR;

a. Should any Government Authority, local or national, refuse to grant


the necessary permits or licenses or clearances for the construction
and operation of the LESSEE’s business or if the Government should in
any other manner, prevent the LESSEE from successfully and
profitably carrying on LESSEE’s business.

b. Should the business of the LESSEE is operating in a continuous


losses.

Under the above circumstances, the LESSOR shall then


immediately return all unconsumed rentals to the LESSEE.

9. That the cost of electricity, water, cable, telephone and other public
utilities shall be for the account of the LESSEE up to the date that
he/she actually vacates the leased premises and shall show proof of
payment thereof to the LESSOR;

10. That in case of non-payment of the rental herein stipulated; or


violation of any condition of this contract, the lease shall be considered
rescinded, and the LESSEE shall vacate the property without need of
demand;

11. That the area should not be used for any illegal activities and the
LESSEE shall be the one responsible for any illegal activities in the
area;

foregoing instrument and acknowledged to me that the same is their free acts
and voluntary deeds.

This instrument consisting of two (2) pages, including this whereon the
acknowledgment is written, has been signed by the parties and witnesses on
each and every page thereof, sealed with my notarial seal, and relates to the
contract of lease of parcel of land.
