Script for Direct Examination of ACCUSED

Q1. Do you swear to tell the truth and nothing but the truth?
A1. I do, Sir.
Q2. Are you aware that you may face criminal liability for false
testimony or perjury if you will not tell the truth?
A2. I am, Sir.
Q3. Please state your name, age, address and occupation.
A3. I am Virgil Sollozzo single, 30 years old, residing at P-Rosas, Brgy.
Washington, Surigao City, and employee of a private business enterprise
in the City.
Q4. Do you know the accused in this instant case, Mr. Virgil Sollozzo?
A4. Yes, Sir. I am the person indicted in the said case.
Q5. What day and what time do you go to work?
A5. I work on every Monday to Saturday from 8:00 in the morning until
5:00 in the afternoon.
Q6. After work, who comes along with you?
A6. My co-employee Mr. Dionesio M. Tangol since we go home
together because we live in the same area.
Q7. At the night of August 2, 2014, do you remember being with Mr.
Dionesio M. Tangol?
A7. Yes, Sir. We went to Abansa Resto Bar.
Q8. Can you tell us what time?
A8. At around 10:30 in the evening.
Q9. Aside from Mr. Dionesio M. Tangol, do you have any companion?
A9. No more Sir, it was only the two of us.
Q10. Why were you there?
A10. Because I receive my pay of my work rendered on the latter part of
July 2014, and I intended to treat my companion Mr. Dionesio M.
Tangol at Abansa Resto Bar.
Q11. Where were you seated?
A11. We sat near the entrance of the said resto bar.
Q12. Was there anything unusual that occurred before you left the
place?
A12. Yes, Sir. Before we left the resto bar, the victim started to utter
offensive languages towards my companion Mr. Dionesio M. Tangol
before going out.
Q13. What did you do?
A13. I said to the victim in an accommodating voice as a form of respect
“Kul, imo man tagbastos ako kaiban”.
Q14. What did the victim reply?
A14. He replied in a strong voice “Kay uman kung tag-bastos, mu awai
kaw?”.
Q15. After that what happened?
A15. I followed the victim outside to make things clear, or at least to
settle the incident by using reason since he was already intoxicated by
alcohol.
Q16. When you followed the victim outside what did he do?
A16. The victim mounted his motorcycle. And started to switch the
ignition.
Q17. What did you do then?
A17. I stood in front of the motorcycle and asked him to step down.
Q18. Was the victim alone during that time?
A18. No, Sir. By that time outside he has a companion waiting for him
also riding his motorcycle.
Q19. After that what happened next?
A19. I suddenly saw the victim shifted gear and pull down the throttle of
the motorcycle which led the motorcycle to accelerate causing me to fall
since I was bumped by the motorcycle.
Q20. What do you remember next?
A20. I shouted in pain, since the part of my body that was bumped was
right thigh.
Q21. What happened next?
A21. A few moment after I was bumped, I heard my companion
shouting at me “Pre pag-bantay kay jaoy ija kutsilyo”.
Q22. What happened thereafter?
A22. I muster the strength to stand up as I saw him approaching with a
knife. Before he could stabbed me I manage to grab hold of his right
hand. And then thereafter we were grappling for the knife which was in
his possession.
Q23. What else happened during the grappling incident?
A23. I suffered cuts in my right hand as a result of the grappling. Thus,
during the grappling I remembered that I accidentally hit the victim on
his chest with the knife.
Q24. After that what happened next?
A24. I fled the crime scene together with my companion.
Q25. Why did you flee the crime scene?
A25. Because I feared that if people will see me within the vicinity they
would attack me.
Q26. After that what happened?
A26. We rode a tricycle bound to Surigao Medical Center in which I
intend to have my right thigh and cuts in my hand medically treated.
Q27. This happened in the early hours of August 3, 2014?
A27. Yes Sir.
Q28. Do you have anything more to add in your affidavit?
A28. No more Sir.
