DEFINITIONS.

When used in the implementation of this Internet Ordinance, the hereunder terms and
phrases shall mean, as follows:

(a) MINOR – refers to a person below 18 years of age;

(b) COMPUTER – refers to an electronic device that accepts, processes, stores and outputs data at high
speed according to programmed instruction;

(c) INTERNET – refers to the worldwide web or system of computer networks in which a user at any
computer can directly access information in the network;

(d) INTERNET PORNOGRAPHY – refers to the visual representation of images showing prohibited acts
mentioned in this Internet Ordinance through any of the electronic devices or means, with the end view
of satisfying the lust or sexual desire of a person, regardless of geographic location, including but not
limited to the following: digital camera, camera equipped mobile phone, webcam or similar gadgets;

(e) WEBCAM – refers to a video or digital camera, usually attached directly to a computer, designed to
take photographs of images and transmit them over the internet;

(f) LOCAL AREA NETWORK (LAN) – refers to a group of computers with associated devices that share a
common communication line and typically share resources and data within a small geographic area;

(g) SATANIC SITE – refers to a website on the internet which displays and or downloads brutal, furious,
vicious, evil, and forceful materials;

(h) SCHOOL HOURS – covers the period from seven o’clock in the morning (7:00 A.M.) until four o’clock
in the afternoon (4:00 P.M.) from Mondays to Fridays, or on Saturdays when classes are held;

(i) SURFING – refers to the act of exploring a sequence of web sites in a random or unplanned manner.

. CLASSIFICATION OF COMPUTER SHOPS. Computer shops are hereby classified as follows:

(a) INTERNET CAFÉ – refers to a business establishment that has a number of networked computers with
access to the internet for surfing, chatting-mail, research, typing and gaming and available for use by a
customer for a fee by the hour or fraction thereof, including cyber cafes, arcades and lounges. It is also a
place where one can use a computer with internet access, most for a fee, usually per hour or minute;
sometimes one can have unmetered access with a pass for a day or month, etc. It may serve as a regular
café as well, with food and drinks being served;

(b) COMPUTER RENTAL SHOP – refers to a business establishment that has more than one (1) or more
computer units that offer access to the internet, typing, printing services, and gaming for a fee; and

(c) COMPUTER GAMING SHOP – refers to a business establishment with one (1) or more computers
connected on a LAN that exclusively offer either online games (connected to the internet) or LAN games
(not connected to the internet).

REGULATIONS.

The following rules, regulations and guidelines must be strictly observed in the operation of the
establishments referred to in Section 05 hereof, to wit:

(a) All establishments hereinabove-described shall not operate gaming or computer games either online
or LAN-connected during school hours (7:00 A.M. to 4:00 P.M.) from Mondays to Fridays, or on
Saturdays when classes are held, as the case maybe;

(b) Students, who are below 18 years of age, shall be restricted to enter the premises of the
hereinabove-described establishments during school hours (7:00 A.M. to 4:00 P.M.), except those who
will be doing research work/school related work or activities: Provided, however, That he or she shall
present a note from his or her adviserteacher or parent stating the authority to do internet research;

(c) Students, who are below 18 years of age, are allowed to enter the premises of the hereinabove-
described establishments and/or play computer games only after school hours, or during weekends –
when no substitute classes are held on Saturday, and/or during holidays;

(d) Business hours of the hereinabove-described establishments for all minors, both students and out-
of-school youth, shall be limited only up to 10:00 o’clock in the evening;

(e) Operators and/or owners of the establishments hereinabove-described shall only be allowed to
operate or cause to operate at anytime of the day subject to the regulations and prohibitions specified
under this Internet Ordinance.

BUILDING SPECIFICATIONS. Internet cafés, computer rental shops or gaming centers must comply with
the following business building specifications:

(a) Proper ventilation (as may be specified by the City Engineer’s Office).

(b) The front wall panel must be transparent and must be free from any obstruction to allow a clear
view of the interior of the establishment.

(c) Adequate lighting both inside and outside of the establishment.

(d) No enclosed cubicles: Provided, however, That transparent-walled cubicles may be allowed.

DUTIES AND RESPONSIBILITIES OF OWNERS AND/OR OPERATORS. Owners, operators, or managers of


internet cafés, computer rental shops or computer gaming centers shall have the following primary
duties and responsibilities; namely:

(a) Ensure strictly that customers comply with the provisions hereof;

(b) Display necessary warning against access to pornographic and online gambling sites, for example:
“INTERNET PORNOGRAPHY AND ONLINE GAMBLING ARE PROHIBITED”;

(c) Check, if possible verify, the identification cards or school IDs and class schedules of students who are
18 year of age;

(d) Install filtering software to remove access to all pornographic and online gambling sites; and

(e) Perform other duties and responsibilities for the faithful implementation of this Internet Ordinance.

PROHIBITED ACTS AND PENALTIES. Subject to the provisions and prohibitions of other existing and
pertinent laws, ordinances or orders, operators and/or owners of the abovementioned establishments
shall refrain from the following prohibited acts; namely:

(a) Engaging or cause to engage; and/or operating or cause to operate without securing first business
license or permit from the Business Permit and Licensing Office of the city government and comply with
all the requirements relative thereto;

(b) Engaging or cause to engage; performing or cause to perform, exhibiting or cause to exhibit, any
sexual, immoral or obscene act, which are offensive to moral, decency and good customs in front of a
digital camera, computer video camera, camera equipped mobile phones, webcams and the likes;

(c) Knowingly and intentionally producing, distributing and transmitting images or videos, which are
immoral, obscene act, evil and violence;
(d) Offering, allowing or cause to allow the surfing of websites, which contain pornographic, satanic,
evil, violent material or those that advertise or promote prostitution and violence;

(e) Using, engaging or cause to engage the trade of prohibited drugs, intoxicating liquor, beverage, or
cigarettes inside the establishment;

(f) Engaging or cause to engage; allowing or cause to allow either direct or indirect gambling online
and/or betting among customers inside the establishment;

(g) Using or allowing the use of closed or opaque cubicles with doors;

(h) Perform any sexually-related acts in front of the computer video camera, camera equippedmobile
phones, webcam and other similar devices either for free or for consideration, promise or reward;

(i) In the case of students, who are below 18 years of age, the following acts are likewise prohibited:

1. Enter the herein-above described establishments during school hours or wearing school uniform,
except those who will be doing online research or school works during vacant or free school hours:
Provided, That the student shall have a written note from the teacher-adviser, or from her or his parent
allowing him or her to do online research or school work;

2. Enter the premises of the herein-above described business establishments without identification
cards (ID) and class schedules duly issued by the school authorities.

ADMINISTRATIVE FINES AND PENALTIES. Subject to the provisions of other existing and pertinent laws,
ordinances or orders, all operators and/or owners and customers of the above-mentioned
establishments, who violated any provisions of this Internet Ordinance shall penalized, as follows:

(a) Owners, proprietors, managers of the establishments referred to under Section 05 shall be penalized
for violation of any of the provisions under Sections 06, 07, 08 and 09, and the prohibited acts under
Section 11 hereof, as follows:

First Offense - An administrative fine of One Thousand (P1,000.00) Pesos Second

Offense – An administrative fine of Two Thousand Five Hundred (P2,500.00) Pesos and revocation of
business permit and/or license to operate, and closure of the establishment for thirty (30) calendar days
Third Offense - An administrative fine of Five Thousand (P5,000.00) Pesos and permanent revocation of
business permit, license to operate and closure of the establishment

(b) Any person, who shall perform any of the prohibited acts under Section 11 hereof, shall be penalized
by an administrative fine of Two Thousand Five Hundred Pesos (PhP2,500.00), without prejudice to the
filing of appropriate criminal action in court: Provided, That, in case the performer, actor or exhibitor is a
minor, he/she shall be considered a victim pursuant to the provision of the “Special Protection of
Children against Child Abuse, Exploitation and Discrimination Act”, and shall be placed under protective
custody as provided in said Act;

(c) Minors, who shall violate the pertinent provisions under Sections 06 and 11 hereof, shall be turned-
over to the office of the city social welfare and development office, or to the women and children desk
officer of the PNP office;

(d) Parents or guardians of minors who violated the pertinent provisions under Sections 06 and 11
hereof, shall be penalized by an administrative fine of One Thousand Pesos (PhP1,000.00). In case of
incapacity to pay the administrative fine, the parent or guardian shall render community services
equivalent for twenty-four (24) hours.
