Notice of Disciplinary Charges

Dear Jonathan:

This letter serves as notice that you are being charged with the following violations of the Student Code of Conduct based on
allegations that on or about November 21, 2019, you in possession of alcohol and marijuana:

1.1 Alcohol Possession/Consumption: Persons under the age of 21 shall not consume or have in their possession alcoholic
beverages on or off campus. Possession of alcoholic beverages without proper authorization in any building (e.g. common area
not designated as "Over 21"), on any property owned, or controlled by the College, and/or is a violation of campus policy,
local, state or federal law is prohibited. Range of Sanctions: Disciplinary Warning to Disciplinary Suspension

2.0 Drug Use & Possession: The illegal use or possession of drugs or un-prescribed drugs constitutes an illegal act and will be
subject to disciplinary action independent of other action taken by civil authorities. In addition, all persons present where they
know un-prescribed drugs are being used or illegally possessed will be subject to disciplinary action, and possible criminal
action. Information: Drug paraphernalia (e.g., bongs, pipes, hookahs, other smoking devices) is not permitted on campus.

Your initial conference will be held Tuesday, February 4, 2020, at 4:30PM, in the Unity Center, Student Leadership
Center 401C. If you have difficulty gaining access to the building when you arrive, please call me at the number listed below.

During your initial conference I will share with you the allegations these charges are based on, explain the disciplinary process
to you, and answer any questions you may have. This is not a hearing, but rather preparation for your hearing. You do not need
to make any statements or respond to the allegations during this informational meeting. However, in some situations students
may be given the option to proceed directly into their hearing following their initial conference. Please bring a copy of this
letter with you to our meeting.

If you have a need to reschedule your initial conference, please contact my office at (607) 587-4047 or email me at
SheparOF@alfredstate.edu no less than six (6) hours prior to the meeting. Should you choose not to attend this meeting, all
charges may be considered true and accurate and a decision rendered in your absence. For more information about the

Rights of Students Accused of Violating College Regulations

Students charged with one or more violations of College Regulations (i.e. “Respondents”) have a right to:

1. Receive a written statement of initial charges. If requested, students will be allowed to examine
any written statements of evidence which the College plans to submit to the hearing body
(written statements are normally reviewed at the initial conference).

2. Reasonable time to prepare for the hearing.

3. Be present at the hearing during the presentation of any matters on which a decision may be
based.

4. Present an explanation of their situation/circumstances at the hearing and ask individuals to


present information on their behalf. However, should students fail to appear at the scheduled
time and place, the hearing will be held in their absence.

5. Be accompanied by another member (defined as a registered student, faculty, or staff member)


of the campus community to serve as “hearing adviser.” A hearing adviser is permitted to advise
the student charged in the organization of their thoughts and presentation of materials and can
advise the student directly in the hearing. Hearing advisers may not respond to any questions for
the accused. Hearing advisers may be present at hearings only.

6. Ask questions of the hearing board/officer and of any witnesses.

7. Present a summary statement at the close of the hearing.

8. A decision of the accuracy of charges by the Student Conduct Committee’s hearing board or the
administrative hearing officer is based solely upon the evidence and testimony presented at the
hearing. If the charges are found to be true, a decision on a sanction can be based upon the
hearing and other matters of record.

9. An expeditious hearing of the student’s case.

10. A written report of the results and findings of the hearing within four (4) business days of the
hearing.
