Facts:

Tarcilla claiming to have proportionate share in the proceeds of four joint and/or accounts that the
petitioner BPI released to her estranged husband without the presentation of the requisites of deposit.

Issue:

Whether BPI acted in bad faith concerning the subject accounts?

Ruling:

Yes, BPI acted in bad faith concerning the said account.

The bank should have ensured the identity of the account holder and should demanded the surrender
of the certificate.

Banks are impressed with public interest. The fiduciary nature of the relationship with their
depositors requires that each account of each client is treated with the highest degree of integrity and
respect regardless of the amount of such accounts.
