RESOLUTION RESPECTFULLY REQUESTING THE PHILIPPINE COAST GUARD (PCG), PHILIPPINE

NATIONAL POLICE (PNP) AND PNP-MARITIME COMMAND TO INCLUDE MUNICIPAL SEA


WATERS OF STA. MAGDALENA, SORSOGON IN CONDUCTING REGULAR PATROLS AND
SURVEILLANCE AGAINST ILLEGAL/DESTRUCTIVE FISHING ACTIVITIES AND PROVIDE
ASSISTANCE TO BOLSTER THE ENFORCEMENT OF COASTAL MANAGEMENT AND FISHERY
LAWS IN THIS MUNICIPALITY

WHEREAS, generally, the constitutional mandate and jurisprudential invocation of the


right of the peoples to a healthful and balanced ecology is a mere token declaration but
communities are still bombarded by practices that violates this rights like illegal logging and
specially illegal fishing resulting to dispossession of sustenance fisher folk community
stewardship to resources;

WHEREAS, prevalence of this blatant violation of environmental crimes on fishing


activities, necessitates the need for the government to act directly and response the needs of
this undertaking;

WHEREAS, the management of municipal waters are responsibility of the local


government unit, but here is continuing lack of manpower and financial resources, to effectively
provide for resource management/enhancement program as well as undertake consistent
coordinative activities with various national agencies towards an effective coastal and fisheries
resource management;

WHEREAS, the local government unit faces the tough challenge and lack of managing
the municipal coastal environment and municipal fisheries resources which serve as a natural
resource base for food and livelihood of rural and coastal communities;

WHEREAS, lesson from the past fisheries management projects and program,
demonstrates that no municipality can do it alone, but need for horizontal and vertical
integration of institutions and resources for an effective management to happen;

WHERAS, there is a need to establish system of a coordinated and cooperative


mechanism between the LGU and other agencies that are mandated and responsible for the
sustainable development, improvement, management, conservation and protection of marine
environment and resources;

WHEREAS, Department of Agriculture Administrative Order No. 10, Series of 2015


provides the Implementing Rules and Regulations of Republic Act No. 8550 as amended by
Republic Act No. 10654, which under Section 158, the above-mentioned agencies are persons
and deputies authorized to enforce this Fisheries Code and other Fishery Laws, Rules and
Regulations;

NOW THEREFORE, on motion unanimously seconded, be it;

RESOLVED, as it is hereby resolved to request as it is hereby respectfully requested the


Philippine Coast Guard (PCG), the Philippine National Police (PNP) and the PNP-MARITIME
Command to include municipal sea waters of Sta. Magdalena, Sorsogon in conducting regular
patrols and surveillance against illegal/destructive fishing activities and by providing assistance
to bolster the enforcement of coastal management and fishery laws in this municipality;
RESOLVED FINALLY, that copies of this resolution be forwarded to the Offices of The
Philippine Coast Guard, Philippine National Police, and PNP-Maritime Command for their
information and favorable actions.
