conducted the Preliminary Investigation which led to a filing of the
subsequent information in court. Was the Preliminary Investigation
proper? Why or why not?

2. After having dinner and while watching his favorite primetime


teleserye, Coco was startled when Police Officers knocked on his
door and showed him a warrant for his arrest. Coco contended that
the warrant cannot be served since it was already late at night and
the office of the City Prosecutor is already closed. Is Coco correct?
Why or why not?

3. When is bail a matter of right and a matter of discretion? explain

4. Enumerate at least five (5) rights of the accused during trial and
explain each.

5. Cesar was charged with Estafa. On the day of his arraignment the
public prosecutor manifested that the reading of the Information in
its entirety be dispensed with and instead the accused, Cesar, be
asked immediately asked if he pleads guilty or not. Cesar’s counsel
did not object to the manifestation and so the lengthy Information
was not read and instead Cesar was asked to plead guilty or not
guilty to which the latter pleaded not guilty. Was the non-reading of
the Information fatal to Cesar’s right to be informed of the nature of
the cause of the accusations against him? Why or why not?
