ON

REQUIREMENTS AND PROCEDURES FOR FOREIGNERS

TO STUDY IN INDONESIAN UNIVERSITIES

BY THE GRACE OF GOD ALMIGHTY

MINISTER OF NATIONAL EDUCATION

Considering: a. whereas The Decree of Minister of Education and Culture

Number 265/U/1999 on Requirements and Procedure for
Foreigners to Study in Indonesian Universities is insufficient
needs changes and enhancement to match the globalization of
education;
b. based on the consideration referred to in point a, it is necessary
to promulgate Regulation of Minister of National Education
about Regulations and Procedures for Foreigners to Study in
Indonesian Universities;

In regard with : 1. Act Number 20 Year 2003 about National Education

System (Gazette of Republic of Indonesia Year 2003
Number 78, Supplement to Gazette of Republic of
Indonesia Number 4301);
2. Government Regulation Number 60 Year 1999 about
Higher Education (Gazette of Republic of Indonesia Year
1999 Number 115, The Supplement to Gazette of Republic
of Indonesia Number 3859);
3. Government Regulation Number 19 Year 2005 about
National Education Standard (Gazette of Republic of
Indonesia Year 2005 Number 41, The Supplement to
Gazette of Republic of Indonesian Number 4496);
4. Decree of President of Republic of Indonesia Number 9
Year 2005 about Position, Duties, Functions,
Organizational Structure, and Work Procedures of Ministry
of Republic of Indonesia as last amended by Presidential
Regulation Number 94 Year 2006;
5. Decree of President of Republic of Indonesian Number
187/M Year 2004 about Cabinet Formation of United
Indonesia as last amended by Decree of President of
Republic of Indonesia Number 31/P Year 2007;

 BE IT HEREBY RESOLVED :

To enact : Ministry of National Education Regulation about Regulation and

Procedure for Foreigners to Study in Indonesian Universities;

Article 1

Terminologies herein shall be defined as follow:

1. Foreign student shall be foreign individual who studies in Indonesian
University.
2. University shall be educational organization which conducts higher education
like polytechnic, college, institute or university.
3. Directorate General shall be Directorate General of Higher Education of
National Education Ministry.
4. Secretariat General shall be Secretariat General of National Education
Ministry.
5. The head of higher education institution shall be the rector of
University/Institute, Head of College, and Director of Polytechnic/Academy.
6. Director General shall be Director General of Higher Education of National
Education Ministry.
7. Secretary General shall be Secretary General of National Education Ministry.
8. Minister shall be minister handling governmental affair for education.

Article 2

Foreigners who are allowed to study in universities in Indonesia comprise those

who are in and outside Indonesia.

Article 3

The requirements for foreigners to study in universities in Indonesian are as

follow:
a. fulfill the requirements to study in universities in Indonesia;
b. has funding resource to fund the study in universities in Indonesia;
c. has been accepted as students in universities in Indonesia;
d. holds study permit from Secretary General;
e. hold visa or stay permit in Indonesia; and
f. comply with the laws and regulations in Indonesia and provisions of the
intended universities in Indonesia.

 Article 4

(1) Procedures for foreigner to study in universities in Indonesia are as follows:

a. apply directly to the intended universities in Indonesia; and/or
b. join university entrance test; and
c. apply study permit in Secretary General;

(2) Study permit referred to in subsection (1) letter c is issued by Secretariat-

General based on recommendation from Directorate General.

Article 5

(1) Foreigners who are outside Indonesia and accepted in intended universities
in Indonesia apply for visa in Indonesian Embassy in their home land by
submitting Letter of Acceptance (LoA) for the intended universities in
Indonesia.

(2) Foreigners who are in Indonesia and accepted in universities in Indonesia

apply for stay permit by submitting study permit from Directorate General.

Article 6

Foreigners who study in universities in Indonesia must extend the study permit
and stay permit base on the study limit of the intended universities, the applicable
laws, and recommendation from rector/director/head of universities.

Article 7

(1) Indonesian Embassy of the foreigners’ home land must report any visa
issued to Directorate General and sent the copy to Secretariat General.

(2) The authorized institution for issuing stay permit reports any stay permit
issued for foreigners who study in Indonesian universities to Secretariat
General and Directorate General.

Article 8

Technical Guideline of this regulation shall be arranged by Directorate General

Regulation.

Article 9

By the promulgation of this regulation, Decree of Minister of Education and

Culture Number 265/U/1999 about requirements and procedures for foreigners to
study

in Indonesian Universities is declared invalid.

Article 10

This regulation shall come to force on the date of promulgation.
