The complaints described their crime as "deviate sexual intercourse, namely anal sex,
with a member of the same sex (man).
Tex. Penal Code Ann. § 21.06(a) (2003). It provides: "A person commits an offense if he
engages in deviate sexual intercourse with another individual of the same sex”. Deviate
sexual intercourse involves any contact between the mouth and any genital or by
penetration of the anus with the genital or with an object.
The petitioners challenged the statute as a violation of the Equal Protection Clause.
Moreover, they assert that the petitioners were adults at the time of the alleged offense
and that their conduct was pribate and consensual
